The other poster is right; it varies by state and insurance company. I'd call my insurance company and talk to them, and also hit the state's DPS/DMV website and see if you can find out if points are assessed for moving violations. Texas only recently adopted a points system; it didn't have one when I left. :whistle:

I'd call a lawyer and fight it...*knock wood* I've had every ticket I've ever not been able to talk my way out of, thrown out of court.

Psh, I would never call a lawyer to fight a ticket. Well, Florida sucks, so maybe. But in FL I usually just pay up and take the course so there are no points.

I know in NY it is SO easy to get out of a ticket. I got one in my home town and it got reduced to a $25 dollar parking on pavement violation, which I did with a lawyer because I'd only had my license 4 months and 3 points on a license held less than 6 mos in NY resulted in a 90 day suspension. Another one I had in Albany County got dismissed because the trooper did not show up, but every other speeding ticket got talked down to something lesser like parking on pavement or depending on how high the speed was, not obeying a traffic signal. Not one person walked out with a speeding violation on their record. And the courtroom had about 60 cases to be heard.

just wondering why ppl are always so willing to speed but never want to pay the consequences for speeding, like speeding tickets.. you broke the law, and if you got caught you should have to pay... it only makes sense... its not like speed limits are random numbers, they are there for a reason... just wondering...

I probably wouldn't contact your insurance company quite yet. I believe in Virginia anyway, it's the insurance company's reponsibility to contact the DMV to find out about driver records not the other way around. And often, if you have been a good driver in the past, they may not check up on you unless you contact them to change your insurance, e.g. putting another driver on your account, or getting a new car, etc. So, if you have gotten a ticket, your insurance company may not be aware of that yet, but they obviously will be if you tell them!

de_sjiem, you are right. We need to be more careful when driving and observing the law. I don't mind paying the consequences in this case, but I was just trying to figure out what the procedures are. Of course, as human beings, we don't want to be punished too much, especially if we are not habitual law-breakers. Obviously if I was speeding all the time, I would have already known the answers to my questions.

As far as contacting your ins co...here's a story that happened to me. When I got married to my ex, he added me to his car ins. Then he's told that my license is suspended! So I go down to the county and lo and behold, some guy's tickets were all filed under my name & then they had suspended my license 3 years ago because of it. It wasn't even like the guy's last name was alphabetically similar to mine, or even his dl # either. At any rate, I cleared it up.

But my own ins co had no clue either...in fact the year before or so, I had gotten a 'safe driver' discount on my ins.

I've only gotten one truly bogus ticket in my life; that was a "speeding" ticket outside of Waco, Texas; my cruise was set firmly at 72mph in a 70mph zone. Cops in Texas won't usually bother with someone going less than 5mph over the posted limit. I was driving north on I-35 and a red sports car passed me on the right (that's illegal) going about 85mph, I estimated. A highway patrolman going south on I-35 turned around in the median and pulled me over. He said I was going 87mph. I told him that he must have confused my white 1994 Plymouth Sundance with the red Ferrari that had just flown past me. He clocked the Ferrari but pulled ME over. It was total, utter, complete B.S. I was willing to cop to going 2mph over the posted speed limit but that's ALL. He actually looked me in the eye and said "Ma'am, don't lie to me; you were going almost 90 goddamn miles per hour." Rubbish! I couldn't take time off to go to court either since Waco is 100 miles north of where I was living and I was a student doing a summer job so I wasn't making much money.

Another ticket was slightly bogus; I made a right turn on red and there was a sign saying I couldn't, but in my defense it was obscured by a tree. The cop admitted it and ripped up the ticket but still popped me for not having my insurance card. That WAS my fault. :blush: The other ticket I got was not bogus; my tail lights were out. I didn't realize they were out, but they were; it's illegal; and I couldn't get out of it. No sympathy for me, but I'm used to that! :lol:

An erstwhile colleague got a ticket for doing 73 (in a 65 zone) near Lilburn in 1998. He happened to own a dark-green Saturn, and had actually been going 68 and was passed by another dark-green Saturn who was actually the offender.

As it was closing in on month-end, the cop wrote the ticket and refused to listen.

Its always best to go to court and contest the ticket, A lot of the time the office may not show up as they might have other obligation, if that's the case you might be in luck and the judge will dimiss the ticket.
