Organize your papers nicely and provide table of contents for your packet.

 

You can attach affidavits, it doesn't hurt, but other evidence is way more important, such as joint bank account statements, joint leases, joint tax transcripts, birth certificates of children born in this marriage etc. You can find list of evidence here, it's the same as for I-130, but USCIS will expect way more stuff after 2 years of marriage.

 

Your packet will get assigned a service center (not call center) using USCIS algorithm, you don't get to choose it.

When you receive Notice of Action, it will tell you the case number. The three first letters stand for service center working on your case.

Thank you so much! Which notice of action do you mean? After its been sent in and received? I heard that the one notifying you to apply (90 days) doesnt always get sent and received by couples but its on them to know to apply. If we do get it, I assume include a copy of that in our submission?

Don’t wait on the letter.  You might get it on time or you might not.  Ours arrived on time, but I was already almost done with the packet because I wanted to send our packet as soon as possible when our window opened.  We did not include the notification of the 90day window and having to apply for ROC - it is not needed.  But, to each their own.

 

Once you send the packet, you will get the NOA confirming it was received and that will act as the extension letter to the expiration on your conditional GC.

After you submit I-751 by sending your packet consisting of the completed form and all bonafide marriage evidence + payment, you will receive a letter called "Notice Of Action" (form I-797).

In that letter USCIS will tell you they're extending the validity of your expired green card by 24 months and they'll note the case number. You can use this letter together with expired green card for international travel or proving your immigration status in the US. You usually receive this letter within a month of submitting I-751.

Yes! We remember the lovely 797's :) Perfect, thanks for confirming. My husband's green card expires in March, so say we dont get a new one in time (that would be a dream) as we plan to apply for it right after Christmas as the 90 day window opens day before christmas eve) , should I husband go to his current employer and provide that letter I assume?

we sent everything carefully divided into sections, marked by bottom tab dividers which were labeled. We also double punched the package as per USCIS instructions. We included a cover letter, which is copied and pasted into this message. Feel free to use it and edit it.

I would.  My husband always gives his employers whatever is new/updated just to be safe.

No. And it’s actually illegal for his employer to recheck his employment illegibility I think. 
 

What I would do before even mailing the package is to go to the SSA office to lift the restriction on his social security card, if any.

Unfortunately, there is a very small chance he will receive a 10 year green card before March 2023. I've been waiting for a year now, like many others. With few miraculous exceptions, people are waiting 12-24 months for approval nowadays.

 

It's best to get an unrestricted social security card from SSA office and renew drivers license (or state ID) with his current green card. These documents would be enough to show to employer to demostrate no need for work aurhorization. Otherwise he can show expired Green Card and I-797 extension letter as proof. Problem with the latter, many employers do not understand, even after 24 months, LPR still has right to work, unless an immigration judge takes away LPR status.

How would we even know if there is a restriction? His current green card says valid for work only (he got it before he got his 2 year green card). do we need to do something now with it/once we get the letter - 10 year green card?

It's the social security card, that may have words "VALID FOR WORK ONLY WITH DHS AUTHORIZATION".

 

He needs to get one without these words.
