Hey folks.

 

I saw some stuff about USCIS recommending interfiling EB3 processes to EB2 to have it be processed faster. I asked my lawyers about this months ago, and they told me it was not possible. A few weeks ago, I saw this again, and I read that it is indeed possible, and again my lawyers say it's not possible. The point is, is it possible? The position my wife was hired for did not require several years of experience or anything, even though she does have experience and a bachelor's degree in, if it helps.

Does she have the 5 years of progressive experince?

 

In order to qualify for EB2 with a Bachelor’s degree, you must have five years of progressive experience that must have been gained after obtaining the Bachelor’s degree. If you are qualifying with a Master’s degree, however, any qualifying experience could have been gained before or after obtaining the Master’s degree

I know it can be done

 

I know some Lawyers do not like doing it for possibly valid reasons

 

Surprised that they would not file when asked to do so by your Employer.

The most obvious one is that do not think she has a strong case, ask your Employer no doubt they would have been told.
