He's been here more than three years, and almost three as an LPR.

Almost three as LPR is what counts as physical presence in the US.

1. Take the Resident Since date from your spouse's Green Card

2. Take the date when you're submitting N-400

3. Add three years to Resident Since date and subtract 90 days from it

4. Are you filing after or on the date from step 3? If earlier, you're filing too early.

5. Since Resident Since date, did the LPR spent at least 548 days in the US, in marital union with you? If so, good. If less, then physical presense test failed.

As for trips before the person became the LPR I'm not sure whether they should be listed. Reading the forums, some people in similar situation only listed trips starting from the Residence Since date and were ok. At the same time, the question asks about 5 year travel history. I guess the LPR can clarify this during the interview.

We'll definitely be filing at the right time. We have worked that out. The question specifically says "in the last five years". That's been the dilemma. You're right, and thanks for reminding us that he can clarify at the interview.

Is your husband applying under 3 year rule?  I read somewhere on VJ that when applying under 3 year rule, every question that asks you for 5 years, only answer it for 3 years. Not sure if that is correct but if it is, then your husband may be OK since he moved here in 2019.

That would make sense. If it is correct it would make it so much easier!

Can I ask how much additional evidence everyone is submitting?

I have bank statements since we got married in mid-2018, and I can get some joint insurance, leases and our state IDs with the same address.

Are people sending in essentially the same amount of evidence as they did for I-751 or a little less? Wondering if I can get away without scanning boarding passes, vet bills, costco membership and gathering photos...

We didn't submit as much as we did for ROC, and only stuff that was new since applying for ROC unless it was required. We kept to the important docs they recommended in the different sections (i.e. tax transcripts, bank statements, leases, insurances). We'll take the secondary stuff (boarding passes and travel docs, photos, etc.) to the interview.

My wife has been eligible since August, but we were delayed due to the birth of our daughter.  Submitted her N-400 today and so happy to be on the final leg.

Her I-751 Removal of Conditions is still pending since Sept 2021 of the canned Re-use of fingerprints.....
