Tax docs for interview in Morocco (split)

Hi everyone! We were DQ'd 6/28 with no interview date yet :(. I plan on flying out to Morocco as soon as we have the interview to be there for support for my husband and provide him with the originals needed. I do have a question about tax docs though if someone could provide some insight.

 

I was unable to file my taxes electronically this year as my husband does not have a SSN yet, so I had to mail everything to the IRS. I STILL haven't received my refund and have nothing to print for 2021 transcript. I did provide my 2021 W-2 when submitting docs to NVC and I have my original for the interview. I am wondering if this will be an issue though. There really is nothing else I can do. Any feedback or suggestions would be helpful. Ty!! :)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

take your copy of 1040 plus W2 and any other 1099 , 1099R  you have with all supporting documents showing u added him to your returns as married if u did the W7  for his ITIN

U will not be able to enter the US embassy (not even in a waiting area) 

 

make sure u take evidence of US residency (passport is not enough-take state driving licence , etc.)

Check the Casa embassy site under family visa near bottom to make sure u have all needed document for USC

don't buy a ticket till u know of interview date

take masks and wear them 

Adil just came back after taking his mom home and had covid (fully vaccinated)   / he thinks he got it on plane but that's a guess

W-2s are meaningless for immigration purposes unless supplies as a part of a complete tax return.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you! I didn't adjust my filing status though. I filed as "married filing separately". I just didn't think there was any reason to file jointly if he is not here, you know? We requested a SSN at time of submitting the immigration application to NVC. I didn't submit anything else other than that.  I'm a little confused and don't want to screw this up now :( I have transcripts from 2018, 2019, and 2020 with 2021 W-2. I hope that will be sufficient.

 

I will definitely have my passport on me, thank you! I'm holding off on buying a ticket until we receive the interview date. I was afraid to mail the documents to him also out of fear they would get lost, etc. 

 

So sorry to hear he got COVID, that's scary! I hope he is ok!

Tax returns do not have to be processed.  Just submit a copy of the complete tax return you have sent to the IRS.

I filed with W7 for ITIN as i  liked the extra deduction (for 2021 $12,550 for one person and $25,100 for 2) head of household is also an option if u have children)

Morocco mail is slow to slower Overnight letter to husband took 2 weeks and a package i sent in October arrived the next year in April

So sorry to hear he got COVID, that's scary! I hope he is ok!

I'm not sure what else I can provide for 2021 since they didn't process my returns yet :(Take copy of your 1040 and W2 as NVC accepted and dq'd

You should have filed MFJ not MFS, leaving some money on the table for the IRS, you can always amend if it is not too much trouble.

1040, W2 and all supporting documents (ie a copy of everything you mailed in to file) for 2021 since your return has not yet been processed.

 

With regards to original documents, unless you have something like a divorce decree, I don't recall any originals that are needed.

I would recommend putting all the documents needed together now and sending to your spouse. Electronically is faster.

If originals get lost in the mail, get new certified ones. Better to have all documents gathered now then waiting for you to travel back.

 

Personally I would not go for the interview because there is usually no allowance for spouses.

Most of the consulates/embassies can ask to see all original civil documents required for the visa interview.  It's better to be prepared than delay the visa decision because one or more original documents are not available for inspection by the interviewing officer.  Each consulate/embassy sends a list of all documents necessary for the interview, typically the list asks the beneficiary to bring originals.  Note the general advice on the Dept. of State website:

 

3. Gather Documents Required for the Interview

Every visa applicant, no matter their age, must bring certain documents to the interview, including photographs, and the original or certified copy version of all civil documents submitted to NVC. You do not need to bring your Affidavit of Support or financial evidence you submitted to NVC.

What happens if you forget to bring something on this list? The consular officer will not be able to complete the processing of your visa. You will have to gather the missing items and provide them to the embassy or consulate, and may have to come for additional interviews. Failure to bring all items on the above list can delay visa issuance.
