I'm filing I864 for my husband petition and I'm confused about the household size. I have 3 kids and he has 2 kids but his kids don't live with us and I'm not filing for his kids currently. His kids are here in the U.S but I'm only filing for him at the moment. What would my household size be? I'm thinking 5 or 7 but I'm not sure.

Hi SteveInBostonI130, you mean my 2 kids will not be counted as my dependent and part of household size since they don't live with me and since I'm not petitioning for them currently?

u dont need to count whoever is not planning / currently live with you. so in this situation, u dont count his kids

The rule is you count your under age children living with you and your any additional of your own kids under 18 no matter where they live, plus the intending immigrant.  If the intending immigrant had kids not currently immigrating, they are NOT counted.  Use the form itself.  Read each question and interpret literally, then answer accurately.  The correct total will automatically be calculated by the form.
