Accepted! But... problems!

Hi, our documents were accepted in April. However, we had a few FE Review notes for me, the petitioner:

1. "Please submit ***'s Evidence of Income.

2. *** might not have a principal residence or be domiciled in the United States. Please submit proof of domicile.

3. Case does not meet the minimum income requirement.

Ever since we got those review notes, we have sent:

1. A written letter from my company stating my monthly income. I live abroad and am paid in foreign currency... will this work?

I've also uploaded my Tax Evidence for the country I reside in. My taxes were filed in the USA via FBAR. I do not know how to obtain documentary proof of this while abroad, as the IRS tax site won't let me log in without a USA phone number

2. I've listed my parents' home as my domicile, and have submitted scans of letters sent to my name at the address for several months: bank letters, voter registration, etc...

I've also included a a scan of my ID which shows the address as my residence.

3. I have also given statements from my bank showing I have saved more than 65,000 dollars. This money is currently in a Chinese bank account. Is this a problem?

When you submit files to clarify any FE Review notices, will the NVC inform you of the FR Review notice being fulfilled? Or do they say nothing and go to DQ or no DQ

 

Just yesterday we got a message that our documents have been accepted, but there are no status updates in the message section. No DQ, nothing. Based on the documents I've submitted, is there a chance it will go to DQ? Or do I need to go digging for more documents? We've just sent a message through the NVC website, but I don't expect a reply for at least a month.

 

One last thing! We are almost coming up on a year of the case being with the NVC. is there a chance that when the year is up, that the case can expire?

Is your current income going to continue after re-locating to the US?  If not, then it cannot be used to prove current income.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your case at NVC will not expire as long as you keep in contact with NVC at least once a year, which you have done.

 

Your current income is $0 if your job will not continue when you move to the US.  If it will continue, you need to provide NVC with information regarding this.

 

You may qualify on assets alone.  However, NVC will send you a note that they think you do not qualify and the decision will be made by the embassy..  This will be just an FYI notice and your case should be DQ'd regardless.

 

For proof of re-establishing domicile, typically you would upload a statement to that effect:  That you plan to be transferred by your company back to the US or that you will quit your job and move back to the US address when your spouse's visa is approved or before.

you need to file US tax returns for the years worked outside the US

your income for immigration will be 0 unless it is with US company and will continue with the move here

you need to either have a joint sponsor or use assets 

read thru the I 864 instructions / instructions for income start at bottom of page 7

The FBAR is a separate entity from a tax return.  An FBAR is filed with the Department of the Treasury, not the IRS.

That will not work.  All US citizens must file US taxes (if required), regardless of country where residing.

1 won't work. Get a joint sponsor residing in US. Refer to @Crazy Cat first post on why. 

 

2 and 3 will satisfy USCIS. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
