Two years ago my wife and I filed for her adjustment of status. We have asked the 800 number at least 4 times to check our case. All the replys that we get are "under review". My wife was advised by a "lawyer" to refile another adjustment of status form again. Has anyone ever heard of this? Is this posible ? Please help... my wife is driving me crazy.

Yes it does happen, I know of another couple on another board with the same situation. It is called FBI name check hell. You may have to sue for the green card.

You may have to sue for the green card

Egads. That is crazy... that's something I would be happy to represent someone for. Sorry to hear of this road block. I know you called the 800 number, but would it help any to make an infopass appointment to speak with an immigration officer in person? Just a suggestion. My sympathies to you and your wife.

same here, i filed my I130 and its been more than 3 years and i dint get approved on it yet !

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

Only consolation is that since you have been waiting this long you should have celebrated second wedding anniversary and because of that the green-card they issue should be the permanent 10 year kind, no conditions to remove.

Is there any known statistic on who gets stuck in FBI namecheck? Like perhaps country of origin, or K-3s, or area of the US they are immigrating to? Just curious.

06/23/2007 - Received medical exam from Civil Surgeon in Fairfax, VA

06/25/2007 - Confirmed negative TB skin test, picked up sealed I-693 and supplemental form from Civil Surgeon

06/27/2007 - Sent AOS package (I-130, I-485, I-864, I-765) to Chicago lockbox (LaSalle address) via Fed Ex

06/28/2007 - AOS packaged delivered and signed for in Chicago

07/06/2007 - NOA1 for I-130, I-485 and I-765

07/09/2007 - Touched (I-130, I-485 and I-765)

07/10/2007 - Checks cashed (I-130, I-485 and I-765)

07/13/2007 - Received NOA1 letters for I-130, I-485 and I-765 in the mail

07/14/2007 - Received Biometrics appointment letter in the mail

No known statistics although there is some 'opinion' that those from the Middle East, India and Asia are harder hit.

Petition type has nothing to do with being 'stuck'. One of the largest backlogs is with petitioners for Naturalization.

USCIS issued a policy memo a few months ago stating they will seek Motion to Dismiss for any lawsuit (Writ of Mandamus) filed against them regarding a namecheck delay. Reason for seeking the Motion is national security takes precedence over a speedy decision. They are following through with this policy, thus making filing a Writ a much less attractive option.

And as far as the OP's attorney's advice to file another adjustment petition - well, that's purely a silly idea.

without more information from the OP, I would be hesitant to say, for sure, they are stuck simply in FBI namecheck. It could be a few other sticking points. Pertinant questions need to be answered like -

where is you file currently?

did you already do your biometrics?

did you move while in the process?

many things other than just waiting it out as normal could be at play here. The USCIS is notorious for giving out wrong information. "Under review" might not be the whole story.

i also filed over a year ago and no news on the I-130 or the I-485 interview. I was told we just need to wait which just shows that there is no accountability in this damn process.

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!
