1. Yes.

2. Well, since you have 2021 IRS transcript, just go ahead and do an I-864A for yourself. I didn't and will avoid explaining the whole debacle with 1040s. There was a reason as to why I was telling you to avoid it but that can be buried since you have the transcript.

3. You cannot have your own transcript that is different from his BECAUSE you filed jointly. However, you can create your own IRS account and will see the same thing he sees because it's joint filing.

So bottom line, file I-864A for YOURSELF.

Okay. I guess that should be the only way out. Thank you!

May I please offer option # 3? No extra forms…definitely no I-864 A ….but do go slow .

Response : Service Error / RFE issued in error.
In response to RFE dated 123, case # xyz requesting the following additional documentation:

1. Intending immigrant’s evidence of authorized employment so that we may include income

We are providing the following evidentiary documentation and factual clarification:

1. Service error in attributing any of the qualifying income to the intending immigrant as there is none and intending immigrant is unemployed.

2. Petitioners/ Sponsor’s Qualifying Current Income =$$$ ( amount from paystubs and job letter)

Petitioner/ Sponsor’s Most Recent 2021  IRS Tax Return/ Transcript = $$$$ as substantiated by the Sponsor’s W-2 in the amount of $$$$.

I really enjoyed this thread, curveballs and all!

I just meant read the proposed Response to RFE and if the numbers on current income field all come from “ paystub YTD “calculations “ and Tax Return numbers do indeed come from spouses W-2 .. and you’ve reviewed each question on I-864 against the instructions…then RFE is an obvious Service Error.

Oh got it. Thanks!
