Why would there be CSPA protection?  The petitioner is a conditional GC holder, removing conditions based on marriage to a USC.

Doesn't CSPA only come into play for numerically limited visas?

The LPR Petitioner ( no matter conditional ) filed for her child ( F-2A) …since backlog and interview set and beneficiary now 22..I am quite certain CSPA protection in place , else she would have aged out and moved to wait in F-2B

Update to our case...

Appointment rescheduled for next week. now my question is:

We file an affidavit of support for my stepdaughter before she was expecting, and baby was born. Do we have to update our affidavit of support showing that we are also supporting her baby as well? or the original affidavit of support is sufficient?

Thanks everyone

Yes update and upload new I-864 to include baby. Well done ! Did embassy respond to you directly via email then NVC updated to add baby’s DS-260 or will be done at interview?

Thanks So much Family for your help!

We even involved our Congresswoman, but still waiting on response :)

They both did, and constant calls to the embassy as well, which I must say, they were incredibly friendly and helpful!.

Will do! we will start working on the update right away!

Thanks again Family! I'll let you know the final outcome soon!

@PRGuy you pulled it off …but please answer if baby is now showing up on CEAC and you paid IV fee and did DS-260 …or embassy just instructed she brings baby to interview?
Does baby have a passport?
Is the father of the baby listed on the birth certificate?
If father of baby is listed , then he needs to write up a letter that he agrees to let baby move to US w mother ..?
