Tax Form Issues

Hi there,

 

I have had a bit of trouble with submitting recent tax forms. My case has been reviewed twice, with each time them asking for most recent w2 forms from my spouse. The last was in march 2022 asking for the 2020 w2. I have yet to hear back but concerned that they are now going to ask for the 2021 w2 as the deadline for payment of taxes was may 2022. Do you think I will need to upload the most recent tax forms once they finally review my case or will them having 2019 and 2020 suffice? My priority date is in 2019. I'm concerned that because of the time it is taking, forms keep expiring and they request new ones, delaying the application event further.

 

It's quite stressful feeling as though the delays are compounding the issue.

 

Has anyone else had this problem?

  1. there's a difference between W2 and tax returns

employers have to send the W2 out by end of January (for the previous year) so she would have it 

IRS is slow since 2020 to process the 1040 tax returns 

but if she has done hers,  she can send copy of 2021 1040 with copy of all W2's ,  and other income received 

the USC should be doing this / by your post sounds like  u r the bene

BTW tax date was April 18, 2022 with October if a person applied for an extension

All of our documents were reviewed and approved previously, only the 2020 w2 was requested in the review note in march 2022, there was no mention about uploading any 2021 w2. My main question is whether I should hold off uploading the 2021 w2 until I hear back or if they will likely request this to be uploaded when they review the application further in the coming weeks? I'm aware the uploading new documents can extend the review time further, so I just don't want to unnecessarily delay the review further.

If you interview is after April 15, 2022 you will need to show the 2021 taxes.  Unless it's after April 15, 2023 in which case it will 2022 taxes.

Do you have the 2021 W2 now? If you do, I would suggest uploading it now before they request it later, which would delay the process even further.

Uploading new additional docs before another review wouldn't reset the clock.

We do, but previously in the application we uploaded a renewed passport which seems to have reset the clock - the timeline says the are reviewing cases submitted on June 13 and I uploaded the passport on June 22nd. We submitted the requested w2 in April, so it appears that it did reset the clock? That's why we're a little hesitant to upload in advance of a reply from the NVC

Thanks Troy, will definitely take most recent tax documents to the interview, it's just whether we risk resetting the clock by uploading them in advance of the request / review by nvc. We had upload a renewed passport page which appears to have reset the review clock based on the online timeline tracker

Just want to make sure I understand your submission timeline first: I assume your very first submission was way before March, during which you got the second RFE note; you then submitted the requested W2 in April and the renewed passport on June 22. Are you saying the NVC hasn’t reviewed your W2 submitted in April because you submitted the renewed passport in June? Do you remember what cases they were reviewing when you submitted the passport in June? I’m afraid that might have been too close to the review of your W2, which might have reset the clock. 

 

I’ve read quite a lot of people successfully resubmitting additional docs before their reviews. We personally last resubmitted 8 days before the NVC reviewed our application. I think a tip for resubmission is to not get too close to the NVC review. The NVC will most likely review your case at the end of next week (if your last submission was June 22, I assume). They’re probably on cases submitted on June 17 as of today. The other experts here could probably tell you if you’d likely get an RFE for the 2021 W2 coz I don’t know and we submitted ours. I’d say the chance is pretty high coz it’s August now. If I were you, I’d submit it by the end of today.

I assume the I-864 you submitted only showed tax return amounts for 2018, 2019 and 2020?  Unless you also update the I-864, the 2021 W2 is not relevant.

I disagree.  2021 W2 will not help unless NVC also requests a new I-864 along with the 2021 tax return information.

Is it likely they'll request a new I-864? The previous one uploaded included those years you listed yes. The rest of the Affadavit documentation has been accepted, granted this was back in 2020. My spouse earns well in excess of any required amount.

Typically, the NVC will not require an updated I-864, unless the data in the one from last year does not show that the sponsor qualifies.  The embassy will more than likely asked for an updated I-864 at the interview.

 

I would hold off on updating it.  If your interview is before April 15 2023, you would need to update the I-864 with 2021 tax information.  If the interview is after that date, you will need to include both 2021 and 2022 tax returns.

Much appreciated Steve, a big help. The last year quaifies in terms of salary, so fingers crossed we'll be DQ'd soon.

Will update my timeline soon for anyone else having similar issues.
