Hi everyone  

We got DQ one month ago  and  waiting  interview letter 

Her is the issue  my husband us citizen  have case  in America  (having unlawful  gun) it 6 years ago ,,and  2 years ago he left America  and stayed in my country  and we have daughter 1 year old  ,and she got her passport 

But they took my husband passport  and told him you have  warrant that he didn't show in the court and he must go back to America in 2 weeks,,,I have couple questions..

1/Is this effect on my case  and interview?

2/Can we ask expedite the interview  because  we gonna have money issues  and we have to spend money for my husband lawyer their in America  (know we have joint sponsor)?

Just curious:  how can your husband travel back to the US if they confiscated his passport?  Will the embassy escort him to the flight and hand it over once he's on the airplane?

 

1.  I have no idea.  For a K1 the petitioner was obligated to disclose their criminal history, for an IR1/CR1 the petitioner does not need to.  It was up to USCIS to conduct a background check, but apparently they missed it or thought everything was OK since they approved the I-130 and you are DQ'd.

 

2.  Yes,  I would request an expedite in your circumstances.

 They will give  temporary  passport to travel directly to America  ,,they told him he can get new passport in America right away

Your expedite request to the Embassy  will not be granted on the reason you gave “ financial hardship “ to cover legal fees….for his felony outstanding warrant. 

The Embassy as you can tell has already taken a pretty strong position on how they will be dealing w you. ….they have IGNORED your thousand emails on baby’s CRBA/passport and they took action to make sure your husband’s whereabouts were disclosed for the outstanding warrant. 

 

So make sure you stay on top of CBRA and ask embassy IF they need anything from your husband BEFORE he leaves , as well as prepare your documents for the interview ( whenever it comes), so they don’t have a reason to find fault.

,but we don't know about her SC number yet and he gonna leave in 10 days 

and my interview letter  at least after 5 months in this embassy,,

And we already have lawyer for my case from the beginning  

 

I feel me and my daughter like lost  we have no one her just my husband,,and I know when he go back he can't come again  until he finish his case 

We really scare I don't know what to do

Im sorry you are facing these challenges but there are consequences for the actions your husband took following his criminal charge .. actions which now impact others who are unwittingly connected .. It is costly in many many ways .. not the least on your relationship and well being. I do not believe that lack of SSN ( I'm assuming that's what you mean ) for your daughter will be an issue. That can be obtained  in person once you are in the US 

 

Make sure you have all the original documents etc that have bern filed as part of your case .. 

birth, marriage , tax returns, I864 paperwork.  
How is he planning on supporting you if he has legal issues and consequences. It is likely you will need a joint sponsor if you dont already have one 

 

Of great importance in my mind, is the bigger question of what all this means for you living in the US. Love doesn’t cover everything .. and actually doesn't fix much at all.. did you know about these charges? If you didn't.. can you be certain there are no other secrets? Does he really understand what his actions have caused for you? Are you the “answer” to his problems.. or is there real accountability and honesty 

Maybe the months before your interview will be a safe period of thinking and reflection for you .. enabling you to see things as clearly and realistically as possible. 
Should you be granted the visa, i think the road in the US will not be an easy one as you establish life there   Good luck

All my husband case was misunderstanding  and we have family their,,because is family  marriage,,yes I trust him and love him and  want  my daughter  grow up between both of us she is so just months old

They took the passport and I assume gave him a boarding foil and will be detained at arrival in the US for the failure to appear. ..don’t think he can bond out . 
 

Although for I-130 only Adam Walsh and DV records would impact grant, I too am surprised they did not flag/ RFE for the outstanding warrant. 
 

He must have thought it won’t come up at all, but OP said they have attorney for the I-130 …did the attorney not warn you this was DEFINITELY going to happen?

I thought   his past  is more important when it's  K Visa    not   CR visa  !!
