Today I recieved rejection notices for my step-daughters. One is 10 and the other is 8. They rejected the application because the girls did not sign in Block 16. I signed as the person who prepared the form. What if one of the girls was only 3 years old, would they still expect a signature?

Application for Employment? Are you sure you mean that?

Completing an application for an employment is the only way for me to get the girls social security numbers. At least I am 99% sure it is the only way.

FORM I-765 APPLICATION FOR EMPLOYMENT AUTHORIZATION

The girls came here under a K2 visa.

Why would a 10 year old and an 8 year old need a SS number? Can't you just wait until they have their green cards?

Causes Tax problems if they don't have SSN's. Also, I am retired military and the military requires that hey have SSN's for thier ID cards. I think it is just about impossible to function in the USA without a SSN.

I'm sure an ITIN number would serve the purpose until a social secuity card can be obtained.

I very much doubt that they expect many 10 and less year old children to file for an EAD. After all I don't think an EAD is appropriate for a child, given that it is illegal for a child of that age to work anyway, even if you are just using it to try to get a SSN. Signing the EAD is a moot point.

I think the ITIN route is what you want to do for tax purposes.

Your kids do not need a SSN number until they are able to work.

For tax reasons you can apply for a ITIN number on a form W-7.

It is possible to get a military ID card without a SSN (I got one for Marlene before she had an SSN). But, Tricare (the military health care plan) will only cover a dependent for an initial 90 days without a SSN. In this case, the OP needs the SSN to qualify his children for health care. The EAD is the only route to do that before they get their LPR cards. The price of an EAD is well worth the ability to be covered for health care.

Just curios. I can see on your timeline that you have recieved a SSN number before filing for AOS. How is that possible?

It is possible for K1. It is not possible for K2/K3/K4/AOS from other visa types.

For K1, it must be applied for within 76 days of arrival or you will have to wait for EAD or permanent residence.

Ok yes I sadly just realized that I could apply before my visa expired which is much too late in my case

It's the I-94 expiration that counts. You must apply prior to 14 days before the I-94 expires.
