May I ask you the letters you wrote ? (whitout personnal informations of course)

We are in the same situation.

Both living in France, my wife (USC) has been living in France for her whole life and doesn't have driver licence nor bank account (We're planning to open one in September as we will be visiting her family) and we will use assets. (Well over the poverty guideline)

I don't know if everyone gets it BUT I saw it happen once or twice this year and didn't want to take any chances with RFEs

If you look at "Financial Evidence and Supporting Documents" under Evidence of Income:

If you completed Form I-864I-864A, or I-864EZ and the income reported on this form or your tax transcript reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. - 

 

People with foreign income generally have an income of ZERO on their tax transcripts so NVC can and sometimes does request some type of evidence of income.

We are still waiting for the I-130 to be approved but trying to prepare every steps of the process to be ready in time !

CO asked a follow up question and my husband replied with the actual city.

We had something prepared for that but the CO didn't request any proof.

If you don't mind me asking, when you said "We had something prepared for that but the CO didn't request any proof". does that mean you prepared the exact place on where you guys where going to to live in the US, such as an apartment or house?

The reason why I believe your husband provided a photocopy is because in the instructions says "Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy". Unless you filed joint income tax return with your spouse.

Correct. We know exactly where we are going to live and prepared proof. But, the CO didn't request to see a lease or communication with a real estate agent. 

Previous reviews I've read here and on another forum led me to believe we would be asked to provide a lease as that most applicants interviewing out of Korea provide that as proof to re-establish domicile.

Yes. We submitted NVC documents at the end of March so decided to use 2021 taxes as opposed to 2020. 

The transcripts for 2021 were not available when we reached NVC

Thank you for the reply. If anyone knows, I'm guessing the people who got RFE for no W2 forum are the people who sent the photocopies of their taxes? What I'm planning to do is even though I'm planning to send them my transcript (if I can manage to get it online), I'll write a sign letter why I didn't upload my W2 form from the previous year.

Right, I should have stated we had a statement about W2s/1099s because we submitted the tax return not the tax transcript.
