My husband applied for a green card for my father-in-law. I-130 was approved, and the NVC says the case has been sent to the embassy in Haiti for an interview to be scheduled. It's been 4 months and we haven't heard anything. We submitted a request for an update on the USCIS website, but apparently they are just now responding to requests from May. My husband thinks we need to contact a lawyer to urge things along; I think that's a waste of money and everything is probably just backlogged (as usual). Does anybody know what the normal wait time is for Haiti these days? Or is there anything we can do?

K-1 Process:

12/04/15 - Engaged (L)

12/17/15 - K-1 submitted

12/31/15 - NOA1

02/09/16 - NOA2

03/16/16 - NVC case number assigned

03/17/16 - In transit to consulate

03/22/16 - "Ready" on CEAC tracker

04/14/16 - Received packet 3 by email

04/15/16 - Medical exam

04/28/16 - Interview - Approved!

05/25/16 - POE at Miami

07/08/16 - Married! (L)

08/09/16 - Filed for AOS

08/12/16 - Case received

NVC schedules interviews, not the consulate.  USCIS cannot give you an update for a case which has been sent to NVC.  Pre-Covid wait time from DQ to interview was up to 3 months.  Backlogs have dramatically increased that time for many consulates.  Once the case reaches the front of the queue at NVC, they (NVC) will schedule the interview.  An attorney will not urge things along. Patience is the key.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I’m confused — so I-130 was approved by USCIS and NVC sent it to consulate?? What about the whole NVC stage? After I-130 approval it’s sent to NVC for further processing where you have to upload documents and wait for a review, have you done that? if it’s approved (DQ) after the review then it’s in line to be scheduled for interview. And why would you send a request To USCIS? They already approved the case, there’s no need to contact them.

Did you request an expedite from the NVC?  That is the only time when you would skip the NVC submission phase and deal with the embassy.  But both NVC and the embassy would need to approve the expedite.

Please clarify .. has the beneficiary.. your father in law.. and your husband, the petitioner.. completed the NVC tasks.. ? submitting the DS260, paying the IV and AOS fees, submitting the required documents .. birth certificate etc.. and the AOS I 864 form snd supporting documents ?

I'm sorry guys, I'm clearly mixed up here.

 

The NVC has the case, we've submitted all the documents (proof of relationship, I-864, etc) and paid all the fees. The NVC said they will work with the embassy to schedule an interview. I spoke wrong when I said they sent it to the embassy for an interview. And the message we sent was to the NVC, not USCIS. My apologies for all my confusion. 

 

So basically, we just continue to wait, right? The last response from the NVC was in March when they said they will work with the embassy to schedule an interview. So I'm wondering if anybody has a clue about what time frame we might be looking at?

That sounds like you are document qualified.  Now, the consulate will notify NVC of available interview date each month, and NVC will schedule interviews based on those dates.  Once your case reaches the front of that queue, NVC will schedule your interview.  In pre-Covid times, the normal wait was up to 3 months.  Many, if not most, consulates still have a backlog.  Patience is still the key.  Good luck.  You are closer than you were...

Below are current timelines for Haiti, specifically IR1/CR1 spousal which would be a good indicator of approximate wait times as it’s also an immediate relative category. People who were DQ’d in 2020 are now getting their interviews so ~2 year wait at NVC. You probably have some time to wait ahead, the only hope is that backlog clears faster:

Indeed you're right about waste of money hiring a lawyer. All the work have been done already there's nothing more you guys can really do besides waiting, which I know is long unfortunately. But sincerely that's all there's left to do wait.
