Form I-894 Questions.

Before I start, I (US citizen) is sponsoring my spouse (beneficiary). We have a child who is a US Citizen. 

 

Form I-894

 

For Part 2 #6:

 

I filed our Form I-130 using the USCIS website. The instructions says if I filed an application using the online filing system, I should have got one. I tried looking, but no luck. I even looked at the Form I-130 approval letter, but wasn't even there. Are you suppose to get a USCIS Online Account Number if you filed Form I-130 online?

 

 

Part 3: Family Member 1

 

Do I need to list our child for Family Member 1? He is a US citizen.

 

 

Part 5. Sponsor's Household Size

 

From what I read online. I leave number 3 blank because I already put the beneficiary in number 1. Please look at the image below.

If you filed I-130 online, there is a USCIS account number. I think it's like your USCIS ID. It's not a must you write it. It's optional. Just print out the I-130 receipt and add it to your package that you'll mail to USCIS.

For part 5 (3) put zero there to avoid confusion. However, 3 is the right number.

By re-reading the instructions, it says "Item Number 4.a -28. Family Members Immigrating More than six months after the Principle Immigrant If you are filing this Form I-864 for the principal immigrant's family members who are immigrating more than six months after the principal immigrant, you should list the names and other requested information in the spaces provided in Item Numbers 4.a. - 28." Since my son is 5 years old, he will come with us once we leave to the US. I'm still confuse if I should put his name in "Family Member 1".

 

Do I need to check the box for Item number 2?

 

My other question is why does my son needs a sponsor when he is an American citizen and can come to the US anytime he wants with me?

All sections after "1" are for people not sponsored in the form. "Persons NOT sponsored in this affidavit:"

You are sponsoring your spouse in the form so item 3 isn't applicable to you.

Use the instructions if you were not sponsoring your spouse. If you were sponsoring a parent or a sibling or a child, you would out "1" on item 3.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

You know this form is also used by joint sponsors, say if you got a friend to help you because you don't make enough to sponsor hubby...so, to make life easier, I always interpret 5(3) to be directed to the joint sponsor i.e USCIS wants to know if the joint sponsor is married. 

 

Your own marriage is covered because the basis of this form is to sponsor your hubby if you make enough. So, you adding him on part 3 is redundant. However, a JS is not sponsoring their spouse but your spouse. So USCIS needs to know. This is all covered in part 1, page 1

So me putting "0" for part 3, 5, 6 , 7 is correct because it isn't applicable to me?

It is already on part 2 (1a-c).
