Yep. No need to offer it if IO doesn't ask for it, but better be prepared than get an RFE or a denial.

Okay thank you. I’m not going to upload it to NVC now because I don’t feel like it is necessary but I will take it with me to the interview just in case they do ask for it while we are there

Where would I find that at?

There is a checklist on the last page of I-864A instructions. It seems that in your case, the IRS tax return would suffice, but check.

Well in my case my joint sponsors spouse does not have any income because she does not work, and I have uploaded his tax return of them filing married filing jointly. So would her writing a statement saying she filed joint with her husband but made $0 income in the year 2021. Total income was earned by her husband and present that to the interviewing officer at time of interview if asked for it?

I will defer that to @pushbrk

Okay question everyone: My joint sponsor files taxes as (married filing jointly) but his spouse does not work or have any income. Do I need to include an I-864A from his spouse even though he is not using her income as she has none? I was told that I can have her fill one out and take the interview when my husband gets his interview and show the IO if he asks to see it but that it is not required. Please help!

I was just wanting to be sure that I don’t need to have her fill out that I-864A because I had heard differing opinions. I don’t think there is a need for it since I am only using his income as she has none. And from what you have stated in previous post I don’t need to have her fill that out until my husband has his interview for us to take it then:So I’m going with that. Is that correct?

I was in the same position - did not upload the I-864A for the spouse, and got DQed without it.

Not sure if the IO will request it, might just fill it out just in case.

Thank you. Are you taking it with you to your interview just in case as well, and if so are you taking anything other than that with you to the interview in regards to that?

Not sure, haven't decided yet. Still waiting on the interview appointment, just got DQed yesterday.

A tax return filed jointly is not "his" tax return.  It's theirs.  You'll need evidence of her US Citizenship or LPR status as well.  I would upload after you are DQ.  You are not just "showing" an I-864a.  It has to be part of the record.  It's a contract.  Read it and understand it.
