How to get my petition back to the USCIS instead of nvc? I came to USA under humanitarian parole, before my spouse petition was approved and sent to USCIS.

My husband sent I-130 petition to the USCIS at the beginning of April, while he lives with me overseas, outside of the Unites States. While our I-130 was in process I got the opportunity to come to the USA under humanitarian parole. I came to the United States at the end of May and we sent to the USCIS form that my physical address is changed to the USA as soon as I  arrived. We provided them all the paper evidence and also requested do not send our case to NVC. We completed also I-485 form and sent it to USCIS by mail. But USCIS seemed ignored all our efforts and sent petition to NVC anyway. How can we return it back to USCIS? What else can we do? I cannot pass interview overseas being in the USA under humanitarian parole

Timeline

No need to worry, the uscis will ask your i130 back from NVC by itself when your i485 is processed. In the mean time, when NVC contact you with a case number, fill out NVC query online telling them you are going with i485 with the uscis.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
