IR1 Case FE Review note: This case does not meet the minimum income requirement to sponsor the intending immigrants.

Hello there!

 

After months of wait we finally got an email from NVC regarding our case update - all documents are accepted but there are two Case FE Review messages :(

  1. This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p.
  2. Please submit the petitioner's Evidence of Income. For more information, visit https://nvc.state.gov/fin.

 

I am a bit confused because based on my tax return and 864 my income is well above the poverty guideline for the past three years, is it because I am living outside of the U.S so they take extra cautious in this case? 

 

My question is, I will be relocating back to the U.S later this year and have a Relocation Agreement from my employer which have my U.S salary in it (just got it last week so that's why I didn't submit the first time) - would this Relocation Agreement be enough justification as "Evidence of Income" since this will be my income in the U.S? Do I still need to fill in another I-864 with a joint sponsor? Also, Do I need to fill another new 864 form if I submit this new Evidence of Income? 

 

As you know it takes about 2 months for NVC to review anything that goes back in the queue, so I really don't want to cause any more delays as I am hoping to move back to the stats with my spouse.

Yes, they can't accept foreign income unless it continues when you live in the US.

It depends, sometimes NVC may preliminary accept it with a note saying joint sponsor may be required at the interview. The CO could ultimately reject the i864 or accept it. If you can have a joint sponsor, better to use one.

In this case I will submit my relocation agreement as evidence of U.S income then, because the salary is sufficient enough above the required poverty line.

 

I will also prepare a joint sponsor as a back-up for the interview later but won't submit it in CEAC. 

 

Do you also happens to know if I need to submit a new i864 along with my relocation agreement? They just asked me to provide evidence of income but didn't mention a new i864, so I assume I don't have to?

If the current income mentioned in the i864 matches with your salary mentioned in the relocation agreement, no need for a new i864. If they are different, then you need a new one. NVC may still ask not accept it and may again asl for the joint sponsor though. It probably depends on who's processing it.

Timeline

There is no need for a joint sponsor in this case.  Your proof on ongoing income once you are in the USA, will be sufficient.   They are not asking for a joint sponsor.  That message is boilerplate, not a request.  People qualifying with assets only get the same message, even if they are millionaires.

Facts are cheap...knowing how to use them is precious...

Thank you! Do you think I still need to submit a new i864 in this case though? My US salary is different from my existing approved 864, in the note they didn’t ask for a new one but I just worry that they will kick back again…thank you!

I would replace all financial documents so they are current.

can you please provide an update on your case?

 

I also received the same update, DQ but income requirement not met since were abroad as well. 


what was your course of action and did you already have your interview? I will be adding a joint sponsor but not sure if I should submit now or just bring the docs to the interview

Hi there - sorry for the late reply, I received interview notice two weeks after and we are preparing for the interview, as well as gather the i864 info from a joint sponsor.  Best of luck to you!
