Maiden or Married

This may seem like a really stupid question but when filling out the I-130 do I use my spouses maiden or new married name?

Consulate: Manila
Marriage: 09/14/2022

I-130 Sent: 09/29/2022
I-130 NOA1: 10/14/2022 
I-129F Sent: 10/10/2022, REC 10/20/2022
I-129F NOA1: 10/25/2022

I-130 NOA2: 8/31/23

The name on her passport. 

Her visa will be issued in the same name as her passport.

Kind of.  Use the name that she plans to use going forward.  Usually that means that sometime during the process, she'll get a new passport or change the name in the current one. (Depending on the practices of her specific country)

 

It's a present tense question.  If she took a new name at marriage, then that's her name.  Paperwork can come later.

Facts are cheap...knowing how to use them is precious...

@pushbrkSo I should be putting her married name on the petition even though her maiden name will be on her passport?

I thought I stated that pretty clearly.  She'll then need a new passport with the married name, but you update that at the NVC stage.
