Timeline

 

My sons aos was denied (letter will be added) 

I don’t know what to do from here. 

I forgot to give in a form in a rfe so they denied. I have the form it is just my genuine mistake. 
I’m being told to file a i290b for motion to reopen and reconsider 

And then being told to refile. Someone please help me. 
(it won’t let me post the picture of the paper)

Agree most cases refile makes more sense

Agree.  Immediately Refile with correct documents and fees.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you didn't respond to the the RFE, then technically your son's only recourse is to file a new I-485.  I've seen at least one case on visa journey where the applicant hired an attorney who did an I-290B in such a case, and succeeded.

 

If you are DIY then refile I-485. Otherwise consult with an attorney.

After reviewing the evidence, USCIS has concluded that you are not eligible to adjust status because you failed to
submit:
• A properly completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor that lists the
applicant as the principal immigrant with all pages present and of the latest edition date, the petitioning
sponsor's Social Security Number, a correctly calculated household size, and a copy of the petitioning sponsor's
Federal income tax return for the most recent tax year with all supporting tax documents.
You have not established that you are eligible for adjustment under INA 245. Therefore, USCIS must deny your For
I-485. See 8 CFR, sections 103.2(b)(11) and (12).

I sent in our joint sponsors and didn’t think I needed my husbands (my mistake)

we don’t mind the time I just want to do this right. spending that again also entirely sucks

As @Mike E has said, I too remember about that case…. But it has happened only once in all my years in VJ. 
To me, in your case, it’s more “simple” to just refile. You can double check in VJ before you submit again so you avoid mistakes.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
