What do I do?

In April, I submitted all the NVC paperwork. We have a joint sponsor. Among the paperwork was an IRS extension for 2021 taxes. That extension is valid until October 15th or so. 

In June, our paperwork was rejected by the NVC b/c we did not have the right marriage certificate. All of the financial paperwork was listed as 'Accepted' in our CEAC dashboard. 

As of yesterday, the joint sponsor has filed the 2021 taxes. 

Question: Do I have the joint sponsor fill out a new I-864 with the current year taxes or do I let it be?

The IRS extension is good until middle of October and our documents will be looked at late August or early September. 

Another rejection by NVC would be really bad for us so I'm reluctant to roll the dice on new paperwork, but I'm also not sure if they will now reject the I-864 b/c the 2021 taxes are still not there.

Yes, have the joint sponsor do a new affidavit with the new information.  The extension solves nothing.  The ultimate decision of the affidavit of support is made at the interview, and the Consular Officer will definitely want to see not only the 2021 tax return but a current pay stub as evidence the sponsor is still working at the job.

 

But....do this by "replacing" documents AFTER you are DQ'd and already in the interview queue.

Ok, thanks. Yes, I was assuming we'd bring the updated I-864 to the interview. No pay stubs, but the pension and Social Security documents I provided and that were approved are up to date, I believe. 

So I'm not going to do anything until after DQ'd, and then I'll replace the documents. Is 'replace' a choice or am I going to be submitting them as an "optional" document?
