This marriage would have taken place before the affidavit of single status could be obtained anywhere but Consular Services in Manila or Cebu, and they had no log of notarizing it for the petitioner.  That's probably how they know the marriage is bogus.

Your friend and her partner should either post on this forum OR hire a lawyer if they are interested in living together in the US.

Why are you so invested in this issue if you are not willing to answer questions or accept the answers about the next steps forward?

While that is good advice, it appears the couple has committed fraud, and really needs competent legal advice to avoid consequences of their fraud.

I will tell to them . I will inteoduce this website. sorry for disturbing you . I just know the real issue and have been witnessed with their love story since day 1. She is getting stressed and I asked for her permission if I can ask people about their case anonymously.. cause she's having hard time what to do next and unfortunately Most of the comments are sarcastic.

No, they’re not sarcastic. There’s no sarcasm in telling you that the CO suspects fraud

Feb 7: EAD approved and interview scheduled

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Well, that and the fact the OP, has clearly stated the marriage certificate itself was obtained fraudulently.

I still do not understand WHY on earth if he was there with her, they would get on a illegal way a wedding certificate? 
 

Why are you trying to get people on Private messages? Hiding details. If you are really concerned about your friend come clean and tell the truth.

 

The situation is, is the document, even if looks 100% legal was not obtained in a legit way and they use that document, knowing what could happen (because in everything they signed have a loooot of information about it) they committed misrepresentation.

 

I don’t know the las in the Philippines but in some countries like Nigeria, if what the person did is a crime on the eyes of the local authorities they can report her.

 

If they have a lot of money and time they can try to pay a lawyer for more advice but like others said, a lawyer cannot change the law. 
 

IMO the best solution if the relationship is real and they love each other, is to start to planning a future out of the US.

Most likely answer is they didn't have time to jump through all the hoops to get married legally.  It takes a full two weeks from the day you apply for the marriage license, and back then, the US Citizen had to get a document notarized at either Manila Embassy or Cebu Consulate, before applying.  THEN they had to have scheduled a pre-marital seminar, not always available during that two weeks.

The way the Consulate would know they didn't follow the procedure is there would be no log of them notarizing that document/affidavit.

 

NOW and for the last year and a half, the Affidavit of Single Status can be notarized by any Philippine Notary, but that was instituted during COVID, when travel ws restricted between provinces.

 

Unfortunately, you cannot undo fraud, and once you're caught, your immigration plans/dreams are dead.
