They probably looked at the date of marriage and date of last visit of the USC and baaamm, they got you lying.

 

This is not just that you throw away and they will forget. This is lying and swearing in from of a consular officer. 
 

 If they are in a real relationship they will find together any other place to live and continue their love story, right?

if u are one of the parties to this,  u can live together in another country but u have ruined chances for a US visa

 

it would be impossible to divorce if the marriage was never legal

omg! lol hello?!! I am already in US got married here lol. using K1 visa and I am on my process of Adjustment of status . Believe whatever you want! 😂

I think that there is nothing we can really do to help here. The couple paid somebody to get the marriage certificate taken care of and were not present at their wedding. The CO is suspicious and wants the wedding picture, they think that something is off and they might be right.

 

I hope it all works out for your friend, but unless they can provide what is requested, the process stops for them!

Tell your friend she really needs to talk to a local attorney that can help her get the marriage either

1. Annulled  or 

2. Declared null and void under local family law ( see link w Fam Code Citation) and easy read examples

But does Anna need to first have a court declare that marriage null and void? Or can she just go ahead and get married without any further ado since the marriage was void?

Anna needs to go to court first.

She cannot just decide for herself that her previous marriage was without effect, was null and void, and have that determination be legally binding. If she wants to marry again, she has to file a court case to have the first marriage declared null and void and she has to win this case.

Otherwise, a subsequent marriage will itself be invalid and Anna can be held liable for bigamy.

 

 

If the relationship survives ( doesn’t sound likely if USC husband got spooked ) , they can start fresh and after a long road back , the worst case scenario is a misrepresentation finding and need for an I-601 Waiver .

 

Even if her relationship doesn’t survive, getting the marriage either annulled or voided insures their future is cleared for whenever Cupid strikes again.

It appears the truth is a bribe was paid to get a marriage certificate.  The groom was not even in the country at the time.  At interview time, the Consular Officer never saw any evidence of time spent together in person the included the date of the marriage.  The visa was at least temporarily denied, with a request for a photo of the wedding.  Since there is no photo of the wedding, they might accept other primary evidence (passport stamps or boarding passes) that the petitioner was in country on the wedding date.  It seems neither that evidence OR a photo is available BECAUSE the petitioner was not in country for the wedding.  This was NOT a proxy marriage, so the petitioner coming later to consummate the marriage would be irrelevant.

 

This visa will not be issued, EVER based on the current petition, and probably not ever in the future not matter what they do, because they've already made material misrepresentation.  

The can confirm all this by the petitioner telling the truth to a qualified immigration attorney in the USA and getting their advice.

 

Facts are cheap...knowing how to use them is precious...

"Ticket"??  Were there passport stamps for entry and exit from the Philippines?  How about boarding passes for actually boarding a plane going to the Philippines?

yes they have too. because they dated their papers exact when the date that the man came to the country.
