Timeline

Hi, my Us fiance is working casual/PT in a restaurant while putting herself through college. Her hours vary, thus does her wage. And of course she makes the majority of her money from tips. She makes reasonable money in the restaurant

She has just relocated to go to college, and in doing so has little savings i the bank. Would it be advisable she use a co-sponsor?

http://www.visajourney.com/faq/k1k2visa-I129f.html#3.3 - Although the I-134 does not state minimum income requirements, there is a near 100% chance you will be required to show 125% of the poverty level for your household including your fiance(e) and any children. (See the link in the references section for Poverty Level guidelines). If you do not meet these requirements, you must still file an I-134, but you will need a co-sponsor who does meet the guidelines. The co-sponsor also fills out an I-134 affidavit.

If your financial resources do not allow you to meet the public charge provisions of the law, and your fiancee does not have sufficient financial resources to feed, clothe, and house you, then yes it would be advisable to find a sponsor who can. If not for immigration purposes, then to keep you from starving or freezing to death - someone will have to pay your bills until you become employable and can find work.

If the "reasonable money" that your fiancee makes in her job at the restaurant is adequate, then she may be an acceptable sponsor - if she can document her full earnings. Many people in jobs such as hers tend to hide their tip income.

Do not forget it is only documented wages and tips that count, if the person does not claim all their tips so they get taxed on them then only what is claimed will count toward the poverty level.
