Hello VJ community,

 

I hope I posted in the right forum.

My mother has a 10 year GC, she lives with us and helps take care of our children.

She needs to get Eye surgery but since she doesnt qualify for health insurance here, and has to handle some personal affairs back home, so early next year we are planning for her to be away for about 8 to 9 months.

We were told that the time limit now for a permanent resident to be outside of the US without having to request a visa has now changed from 6 months to a year is it true? I searched online on the USCIS and didn't find any recent update.

All I could find thru Google is that if you spent less  1 year and 1 day outside of the US you can travel back to the US without a travel permit/visa request but of course it will be at the discretion of the immigration officer.

Anybody heard anything about this recent change or have a recent experience about this please?

01/22/2018: 3 NOA's received in Mail (I-130, I-485 and I-765)

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/12/2018: Early walk-in for Biometrics, successful

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

Reminders about Green Card Benefits

Over 6 months triggers a  break in continuity of residdncy for naturalization purposes.. over 12 months triggers the question of failure to maintain lpr conditions .. not difficult to overcome if strong ties are maintained .. but for safety i would recommend she applies for a reentry permit which gives her up to 2  years out of the US without any ussues with reentry. She can apply, stay in the US until she does biometrics, then leave and pick up the permit at her overseas US consulate. She may plan for only 9 months but you never know what may eventuate

First question is about how she well get it done in Canada?

 

Also she does qualify for Health Insurance as a US PR.

There has been no change in policy.  Over 6 months can cause scrutiny.  Over a year will require a reentry permit.  But,  @Boiler raises some good points.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

(Assuming she’s from Canada), you might want to confirm that she hasn’t lost her provincial health care coverage by becoming a US resident.   @Ontarkie ?

My mum is from Ivory Coast, that's where I am originally from and where she plans on getting the Eye Surgery sorry for the confusion

For Health insurance she does qualify you are right but private plans are so expensive and since she didn't work here she doesnt qualify for Medicare yet according to my research, (we are in MD) and I cant add her to my health insurance through my job

 But If you have any tips for me I will gladly accept about affordable health insurance plans. She got her GC in Dec 2020
