As far as I know you loose your Permanent Residence status if you spent more than 1 year outside the US. I would suggest you check if before you move...

I wouldn’t leave it until January personally. You’re expected to make the US your permanent home from the moment you land and become a green card holder, so a few months to finalise stuff in Canada and find somewhere to live would be ok, but not longer than that ideally - it’s not worth risking, particularly with the current administration. Just to confirm, you’re an EB2 NIW applicant, not ’normal’ EB2?

 

And make sure you start building ties straight away with the US i.e. get your bank account, phone, health insurance, and a property asap.

You can lose it with less time than that, and keep it with more. The danger is that somebody who hasn’t moved yet won’t have the ties to show if questioned that others would have i.e. tax returns filed, property, car, job, etc.

My visa is EB2-NIW. I really appreciate all the insights here.

 

As far as I know, being outside the U.S. for more than a year as a Green Card holder is very risky—it usually results in being referred to an immigration judge. While they technically can't deny you entry just because of the duration alone, it raises serious red flags.

 

Even being outside the U.S. for more than 6 months but less than a year can trigger issues—they might take you to secondary inspection and question your intent to reside permanently. Less than 6 months outside the U.S. is typically okay, especially if you have clear ties to the U.S.

 

My challenge is that I’ve just activated my Green Card about 10 days ago, but realistically I won’t be able to move permanently until next January. In the meantime, I plan to make a few short trips to sort out things like housing, job hunting, and setting up essential services.

 

And yes, with the current administration, I agree—it’s hard to know how strictly these rules will be interpreted, so I definitely want to play it safe.

Agreed, and that’s why I wouldn’t leave it until January personally - you won’t have those ties until you do move. It’s not just time outside of the US that matters, it’s also being able to prove that you’ve made the US your permanent home, so somebody could be risking their LPR status after MUCH less than 6 months.
