Thank you. It looks like EB5 is not following EB1/2/3 IL dates. I was dq'ed in Aug-24 and my attorney informed me that IL can be expected anytime now.

Not sure how true this is. Seems Montreal lumps all EB categories together, so have that at the back of your mind.

I agree. It does not really speed the process whether EB 1/2/3/5. The DQ and the currency seem to be all that matters. It seems there are 12 months of waiting for the IL. My DQ is at the end of January, so I'm hoping to be on the next patch.

It would be nice if EB5 gets their IL on a faster timeline, but I assumed that Montreal treats all EB the same (DQ+ VB Current). Our PD dates seem to be earlier than most other EBs, but my lawyer said that I can expect IL between mid to late 2025.

You'll see that between what immigration lawyers say and what actually happens there is a big difference. People's experience on Visa Journey is way more accurate. EBs definitely are all together in the line for the interview. But you seem to not want to believe it, you've said this a couple of times.

If you’re in medical field with job offer, then they can expedite the process for you. Otherwise, all EB applicants are in the same pool. It depends on your PD and DQ dates.

Montreal maintaining 12 months EB backlogs. Worst case you’ll get IL by Nov/Dec-2025. Sometimes they bundle up 2/3 months ILs together. That being said, in best case you’ll get IL by 2025-July/Aug. 

however, i’m not sure whether there is any yearly cap for EB5. For instance, EB2 has a per country cap of 2800/year

I was just sharing the information received from my lawyer. It makes no sense to lump EB5 with other EB's as both visa types have huge variation in terms of number of applicants. Montreal is processing around 100 EB5's every year versus 1000's of EB1/2/3. Anyway, appreciate your input and hopefully we all get our processing done as per our expectations.

That makes no difference. All EB applicants are the same tier for interview scheduling - https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visas-news-archive/immigrant-visa-prioritization.html

Yes, there is, last year the cap was met in August so then no further visas could be issued until the new fiscal year.
