Thank you. Just wondering if the consulate officers actually follow that in practice.

They should follow it and I would say I have the exact same issue, and my lawyer didn't ask me for a new PC. These are the guidelines. Give  the officer a copy of the NVC website saying that quote in case they ask for a new PC, this should be enough to justify not submitting a new PC.

But ... I guess if the officer is insisting too much, there's not a lot you can do at that moment. Usually if they are insisting, it's for some other reason related to the particular circumstances of the individual.

Hello, 

 

My husband and I submitted our i140 eb2 NIW documents in Aug 2022. However my husband has received a job offer in America that he wants to take. He is Canadian - so could go down on a TN-1 visa in 4 weeks. However I am from the UK so would need to go down on a TD visa - and be unable to work. Can we do this while the i140 is still in the process, and then change to adjustment of status and apply for a EAD whilst awaiting for the AOS green card? Would going down on a TN visa affect the i140 NIW?

TN visa is a single intent visa so if the US border finds out that you submitted your I140 eb2 NIW then they could refuse your entry.  You should be cautious and talk to a lawyer.

Just FYI, what you are suggesting is considered illegal since TN requires non-immigrant intent at the time of application. Only H1B, L1, and O1 visas allow immigrant intent.

A quick question: what is the name of the the test that is used to find the vaccines one has received. I remember it being discussed on the forum but I am unable to find it now.

I don’t have any vaccination card.

I went to my doctor and explained it to them. They referred me to LifeLabs and I got the test done. No cost for the test. But my doc will charge me to fill out a form that Dr. Lyndon has on his website for the vaccines.
