Visas issued. There have been no interview letters gone out to eb in months. This is likely just people that were put into AP and had it resolved.

Is there anyone prior to May 2022 in this group waiting for an appointment. My DQ month is May 2022 and I was hopeful to be in the next round of invites.

TN is a non immigrant visa just like a B1/B2 and most of the  non immigrant visa excluding H1 and L1 have single intent. But on the DS5535 blog there are tons of users who were put in AP and have travelled back to US on their Canadian passport which is basically a visitor entry. So the data is very clear that there is no issue because you already showed intent for consular processing rather than AOS. The rule is very clear that you should not have an immediate intent but you can have a future intent. However your answers at the border need to be well defined. It always has to indicate that you have intent to leave the country. Being put in AP is a good reason because you will have to leave the country for a next set of medicals and drop passport at Montreal. Currently AP in Montreal is taking approx 6-18 months to clear. 

Could you explain what AP mean? Is it Advance Parole travel document to be able to get into US after Montreal interview? Thanks

In this context. It is administrative processing. It happens if you are not approved for the visa after the interview in Montreal. There are many reasons. Sometimes you are missing documents, or something comes up during the security checks. 

 

Currently the wait if you are put into AP is up to 18 months after the initial interview and montreal have been putting a large number of people into this category. There is a whole other blog post for that because it happens to so many people. Sometimes after this process people are approved. Sometimes rejected and it needs to be appealed - which is also a very long process.

I'm reaching out to seek some advice from you. Over five years ago, I relocated from Canada to the USA on a TN visa and transitioned to an O1 visa a year and a half ago. Like many here, I'm striving to obtain a green card (EB1) through consulate processing and my DG date is May 2023. I opted not to proceed with Adjustment of Status (AOS) to maintain travel flexibility.

 

After nearly 10 months of waiting for an interview date and learning about the numerous issues with the Montreal consulate and their delayed issuance of Interview Letters (ILs), I consulted with an attorney about the possibility of transferring my application to the US consulate in my home country, Morocco.

 

Before I proceed and request to NVC to relocate my case to Morocco, I have some questions and concerns I hope someone here can address:

Will transferring my case from Montreal affect my DQ date?

I hold dual citizenship but only possess a Canadian passport. Can I utilize the Canadian passport to apply for a US visa in Morocco?

Folks some awesome news to share. Just received invite from NVC for an interview at the end of March. Dq date was May 2022 so it’s in line with the website date

Just to let you all know, I got the invite for the interview as well for the first week of March.

I hope one of the Iranians who attended the interview can answer this question. Are they looking to see the new smart with chip military service card or they are ok with the old one without chip?

My heart breaks reading this.  No one should expect a DS-5535.  Active discrimination at it's finest.

Unfortunately that is the reality.  Anyone with ties to Iran is getting the DS5535 as mentioned on the Montreal 5535 VJ blog

I know.  I've been following the Montreal DS-5535 thread since it's inception.  It's a rob Peter to pay Paul scenario of shuffling the buck.
