@TheMaverick Thanks! My lawyers requested an expedite request last month but was denied  and yes, I am from healthcare sector.

Are you both citizens of canada or ROW? Just wondering if they are   sending IL or prioritizing  people born here. That did not use to happen but who knows what are they upto.

 

I am a Permanent Resident. My chargeability is in the Philippines.

 When did you apply for canadian citizenship?

We applied for Canadian citizenship in Sept 2021 and finished our Citizenship test in April 2022. Its already late ( many before us already are citizens now :) though we wanted ours to be as delayed as possible so that we can finish our US consular interview before ) so we should hear about Oath ceremony anytime soon

I recently became a Canadian and applied for a Canadian passport. Our US lawyer told us that it will have no impact on our EB Application or MTL interview. The lawyer recommended that I do not reopen the DS-260 but mention my new passport/citizenship at the interview.

 

Personally, I think its better to have the Canadian passport in hand as it might help you avoid AP (intensive background screening by Canada, etc.).

Again, no idea if that will actually happen but, as usual, we remain hopeful!

 

Good to hear. Did you hire an attorney on your own or from US employer for US consular process?

US Employer hired the attorney and since we became Canadian wants us to relocate on TN. I'm very confused about that...

Attorney says go for it and then get AOS. That's another couple of months... the uncertainty!

any thoughts?

There seems to be no correlation between birth country and interviews.

That issue most likely pops up during the interview and hence higher number of APs from particular backgrounds/countries.

I guess going on TN visa and doing AOS has its own risks ( I hope Attorneys know what they are doing and their experience/ expertise matters a lot) but it might reduce the interview wait time at Montreal consulate. Its always a hard decision to choose either way.

Hmmm.... that's such a grey area as to what might we need to do as preparation to avoid complications during interview. Since the interview wait times are so prolonged, life keeps moving forward and things change which might complicate the paperwork so much :(

I received my IL this morning! I am an EB-3 Registered Nurse. Born and raised in Canada.

 

Timeline

I-140 Submitted: April 15, 2022

I-140 Approved: May 5, 2022

NVC Welcome Letter: August 25, 2022

NVC Documents Submitted: Week of October 31, 2022

NVC DQ: November 24, 2022

IL Received: January 7, 2023

Interview Date: February 27, 2023 0830

Do you have a TN or do you have to apply for one? If you have to apply for one it will get tricky because they will know about your application. You can prove non immigrant intent by telling them that you have selected consular processing. TN is a a single intent visa and doing AOS ON TN has its own risk. You will not be able to leave the country till your EAD and AP is not approved. The attorney has their own agenda of charging you and moving the paperwork from NVC To USCIS. Also remember you can apply for AOS only 90 days after entering the country. At the AOS interview they can still question your intent and if they are not happy with your answers they can reject your application. Consular processing is the safest bet.
