Hi Everyone,

I am engaged with a US citizen. I have a question about the criminal record. I was committed with stealing in Dec 2004 but the case was dismissed after I paid a fine. I know I was young and stupid at that time. I haven't done any illegal things since then. I also don't want my fiance to know I have done it.

We just mailed the I-129F application. I would like to know what do I need to do next? Do I need to tell the USCIS I have done it? Also, I would like to know do u need to bring all the documents (police record) to the interview?

If you are the US Citizen, this has no effect on the petition, you do need to disclose certain criminal background items for the I-129F, but stealing is not one of them.

If you are the foreign citizen, you need a police report for the interview and it may or may not show up on the report, one offence tends to not be a problem.

You need to do nothing about USCIS, just sit back and wait.

One last note: your profile shows Hong Kong, so you may be interested in "A Candle for Love" that site covers Chines/American immigrations and relationship issues, mostly for the consulate up river in Guangzhou, but has a lot of info for preparing for the interview and many culture discussions.

I am a foreign citizen and am very nervous with the whole process. I have some questions on filing for Form DS-156 and DS-230:

In Form DS-156, under question #38:

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance (drug), or been a prostitute or procurer for prostitutes?

If my case was dismissed, will I check on 'yes'? But at the beginning says: A visa may not be issued to persons who are within specific categories defined by law as inadmissible to the United States (except when a waiver is obtained in advance). Is any of the following applicable to you?

Do I need a wavier? or will I be failed to apply for the K-1 visa?

Also, in Form DS-230, #31: Have you ever been charged, arrested or convicted of any offense or crime?

I am going to write yes and explained what had happened. Also, I will attach the court file and police report. Should I mail the original copy or should I get certified copies?

You MUST be as honest as possible and explain any and all of it. And, it seems to me you must check yes on both of those.

I would attach certified copies.

I advise you to obtain the police report and get the Notarial translation made before you fill out the visa application. It will be a good reference for correctly and honestly filling out the applications. It is unlikely you will be able to conceal anything on the applications from your fiance.

He already known that. I am just nervous on filling out the applications and might have a chance to get denial. Should I attach notary copies to both forms? or just bring one in with me during the interview?
