Hey everyone. After a year of agony, my girl is almost here. She had her interview in Guangzhou last week and got her visa, and she'll fly here on the 24th. A BIG thanks to everyone on this forum for helping us this far, you guys (and girls) were a huge help in guiding us through this long and confusing process, and we greatly appreciate it.

Anyway, I just have a few questions about what to do after her arrival. I'm sure y'all are aware of the price changes going into effect at the end of this month, so we are trying to get it done before that.

I'm confused about which forms I need to file. Is it the I485 or the I539? Also, do we actually have to have a wedding before we file the forms or will a marriage license work? Our plan is to go get a marriage license the day after she gets here, but if we have to have an actual wedding before doing that it will screw up our plans.

You have to have a marriage certificate to file for AOS, meaning you have to be married. For info on filing for AOS please use the AOS forum, where you can find the guides, FAQS and ask questions to people who have already been through it.

Also, the EAD too ( for employment). Since you are not married yet, I THINK you might also need to do the I130 ( i am not sure) i just have read other ppl submitting the I130 with their AOS/EAD so I am assuming those were the K1 ppl. If she is arriving on the 24th and the fees go up the 30th that is too close to beat the fees but who knows, best of luck!!!! and CONGRATS on your wife's arrival

Well, let's say she gets here, and we manage to get a marriage certificate super fast. I fill out all the paperwork I need, put a money order in the envelope for the current fees, and overnight it to them. Should work, right?

You don't need an I-130 but you do need to show proof you married in the US after her arrival. Here is a list of documents I'm including with the AOS I'm expecting to mail today. I haven't double checked to make certain I have everything on the list that needs to be, so feel free to use this and any comments on it for your reference. I'm filing for a daughter too so of course you can't use it verbatim. You would also add the marriage proof. I intend to add some proof on ongoing relationship as well but haven't listed that yet. In our case, bank statements etc. (They've been here nearly 11 months already.)

The following is a list of contents in order of appearance.

- Checks # 1474 and 1475 for two $395 Filing Fee

- G-325A forms for both applicants(quadruplicate)

- Copy Birth Certificate for each applicant (Notarial Translations)

- Two Passport type photos for each applicant

- Copies of I-94 and K3/K4 nonimmigrant visa pages for each applicant

- Two Photocopies of my Certified Copy of US Birth Certificate

- Two I-864 forms from me, the sponsoring Spouse/Step-Father

- Two copies of most recent three year’s tax transcripts for Sponsor

The application and original forms are original documents. Supporting documents submitted are either original documents or exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

Thanks for the info. It's looking more and more like we won't be able to get in before the price change :( What concerns me most is the proof of marriage and the certificate...not sure how we could get that quickly. If there's absolutely no way we can do this before the end of the month, then I might as well set her flight date to next month to give her some more time.

Don't forget Vaccination supplement, I-693A, well you could forget it if you don't have time to visit a Civil Surgeon to get this done, and see if you get an RFE for it, or they will instruct you to bring it to the AOS interview.

The AOS Guide spells out exactly what is needed to adjust status.

first off, get married and enjoy

you can have the forms ready to go and then add the Marriage Certificate prior to mailing.

Why the rush to beat the fee increase, the increase could potentially save you a lot of money if there are any delays in your case.

Coming on a K1 you don't need the I-130.

You will fill the I-485 and you should check the guides for the AOS they are great help and will tell you almost everything you need to do.

You will both need to be there to obtain the marriage license. If I were you I would ask if there is a waiting time between when you obtain your license and when you get married (some states do, some don't). If you need witness and how many. With those informations you'll find out if you can or can't beat the fees. Depending on what you find you might want to get married in your state or in a close one.

When you do get married, ask the magistrate to give you the signed marriage license, explain that you need the marriage certificate right away for immigration and then go straight to the register of deeds to get the certificate (plan money for the magistrate, license and certificate).

She needs to have her vaccination record put into a special sheet, so try to contact a civil surgeon (the only ones allowed to do it) to have it done if you don't have the I-693a (I think that's how it's called) already. Shop around, check also the AOS forum for advices on that, there are plenty of posts on the question.

Fill in everything you can. Discuss with her whether she'll take your name or not. Download the forms from the USCIS and write down everything that you need.

The proof of marriage *is* the certificate... and you might well be able to get a copy of that on the day, if you're having a civil ceremony. That's what we did - the judge allowed us to run over to the clerk's office with the signed marriage licence straight after the ceremony, and we had our certificate in our hands about 2 minutes later. It can be done! :)

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Very interesting. And yeah, I would like to take this nice and slow, but since I'm short on money at the time we would like to beat the fee increase if at all possible.

Yes, copies of returns will work too, but then you need to make sure you include copies of any W-2s.

In applying for the I-485, you'll need to fill out the I-864. You'll need a tax transcript of your latest tax return. Have you obtained that yet?

We still have the tax info that we used in Packet 4 for the final interview at the consulate, which includes copies of my returns for the last 2 years along with the W2's. That should be all I need, right?
