Mom passed US citizen interview, but DAD failed

Hi forum. Hope everybody is in good health!!!!
My question is:    My parents went to the their second interview today  ((N400 through me))  I'm a us citizen also. Both of them failed the first interview)).  My mother passed today, and now she is a US citizen (she even swore today) but my father failed again. I know that he has to wait 5 more years to apply again, but I want to know. Now that my mom is a us citizen, she can petition him right away? or she has to wait some time because my dad has failed his interview ? or that doesn't matter and she can petition him right away.

Your Father can reapply anytime. Nobody petitions his Naturalization. I assume he failed English and/or Civics?

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

He'll get a mail on how to proceed. 

I mean, he can then repay and refile but after you get the mail. However, the only difference between citizenship and GC is voting. So, if he doesn't care, he can continue with GC & renew every 10 years.

 

N400 has booklet in Spanish, FYI, free online. Maybe that can help him better. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Maybe she initially petitioned for his green card.

Hi, thanks for the replies guys. Sorry about the confusion, my mom wants to file for him right away the n400 through marriage.  Also I filed for both of them, through family (I''m a us citizen, and his son),so they went to the interview with differents IO, because I  filed for them individually ( one n400 for each of them)

You need to research this process.  That's not how this works.

Why do you think Dad needs “ to wait 5 more years to apply again,…”. He can re apply as often as he wants.Linked an easy read FAQ by USCIS, see #25

 

Just be sure he can manage the language. To qualify for test in native tongue, depends on how many years he has been LPR and how old he is .

Problem is he can't manage the English language. He is already 76 years old (7 years with his green card), and the only hope that he has  is to reach the 20 years with his green card (he'll be 89 years old at that time). I don't see a light at the end of the tunnel for him, from that  part :(.  So his only hope I guess it's if  my mother  filed a new n400 though marriage, instead of me, now that she is a new US citizen

Agreed with you in that  part , but because is now through marriage I don't thing the civic questions is going to take place in that  occasion, but about the relationship about them, and personal things . and to be honest is gonna be hard for dad to pass those questions even if they have to go together to the interview if it takes place of course.

He would qualify to take it in Spanish under  55/15     So another 8 years. Nothing your mom can do to help him out , even though she just became USC. 
 

The only exception is for  Medical Conditions that have cognitive impairment (;ex Alzheimer’s, dementia onset or ..) and a doctor would certify w N-648)….but God Willing your Dad remains a healthy LPR .
