Most people file them together but you can file them sequentially

I was in the process of getting my AOS packet ready and I got the notification my I-130 has been approved. Can I still adjust my status? If so does anyone know what happens? Thank you! :)

Include a copy of the I-130 approval in the packet with the I-485 package.  In your case the I-130 approval is the entire basis for the I-485.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your AOS will be super fast and likely interview waived, so just send it in

What makes you think that?

It is much more likely to take as long as AOS is taking when adjusting from K-1, which is many LFOs is up to 24 months.

IMHO , USCIS has set up quite an effective streamlined process for new apps since March 2022 announcement of risk based and Service Centers expanded powers of approvals.

Those filing split ( online I-130 and paper I-485 ) report I-130 approvals in less than 60 days.

In my not so humble recent hands on experience , an I-485 ( w prior approved I-130) filed mid March, scheduled for interview ( 5 minutes long) end of April and green card in hand in 2 weeks.

They have yet to deal with those caught in prior admin and pandemic backlogs, I agree

probably because of the PD of i-130. happened to me.

i-130 stand alone 11/30/2020 ( not approved when i filed for i-485)

file i-485 2/7/2022

got interview on 6/28/2022 while some people who filed AOS concurrently in Feb 22 in the same field office havent got interview yet

i know its small sample but still

more and more people reported that their AOS interview waived especially if married less than 2 years.

there's no consistency obviously but i noticed it happened a lot this past 3 months

Thank you for the replies everyone! So what actually happens after filing for the AOS is it the exact same waiting time as if I hadn’t been approved for my i130 or would it be quicker? It make me think twice about applying for adjustment of status if it’s going to take a year and it would normally be quicker sticking with the usual route? Thank you for any help :)

Thank you for the reply! So you think that since my i130 is already approved AOS should be quicker? Thank you very much for the help! :)

I also would not count on having the AOS interview waived when adjusting status on an ESTA where immigrant intent was denied to CBP.

Thanks for the reply! I’m not concerned about the interview I’m more worried about the timeline being pushed back to the beginning when I’ve already passed the i130 stage if that makes sense? Thank you!

Thank you! Do you know if it will be a longer process? :)

Why did you not file them together?
