Form i-864 - I have not yet filed taxes

Hello,

 

I have a question regarding how to proceed with form i-864 with respect to question 6.23 regarding taxes (See image). I am a little behind on my taxes - I have not file this years nor last. These are my options for answering the question:

 

1. Check "No", attach my most recent file from 3 years ago.

2. File taxes immediately, check "Yes", file i-864.

 

My question is regarding option 2: should I wait for the IRS to accept my taxes before filing form i-864, or is it enough to have postmarked them?

 

Thanks in advance.

 

PS: regardless of response, I will be filing my taxes immediately.

Yes. … Once you have filed. You will need the transcripts for the interview so the IRS needs to have processed your returns by then .. but you've got time to get that done

it has to be 2 as it also says

  1. NOTE:  you MUST attach a copy or transcript of your federal income tax return for only the most recent year

check yes 

and submit (as it says) copy of the most recent year / i would submit copy of 1040 with copy of W2's

AFTER April 15, the current year's tax returns (in this case, 2021) have always been required by Guangzhou. No transcripts are required - you can simply include a copy of your returns as filed.

 

You may want to have the transcripts ready, but I would not DELAY your application for them - it is VERY rare that Guangzhou would require them
