Adding spouse to ds 260 Derivative beneficiary (spouse) (Merged)

Timeline

Rather than starting a new thread, better to continue your existing otherwise the same info that you already got in your earlier thread will repeat.

 

Anyway since you mentioned in your other thread that embassy denied unlocking DS-260, now the option is your wife travels to the US, becomes the LPR by doing so and asks NVC to start the processing of follow to join benefits for you. Either NVC will unlock DS260 to process the new application and collect your civil documents or it will direct toward the embassy.

 

I assume since the visa was just issued, the embassy isn't willing to do the follow to join before she becomes the LPR.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

Sorry about that. I’m new here. I saw some text about “self deleted“ in the post immediately preceding my last post on the previous thread and thought the thread had been blocked. 

 

Can the embassy really do that? Don’t they have to follow directives from their umbrella body (state department) especially if the directive is unclassified and can be accessed by anyone?

But you do think That I would be eligible for follow to join?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The embassy may not be doing anythinf against the policy. Follow to join can be do e after one become LPR which your wife hasn't been yet or at the visa interview so the derivative can be interviewed much later in which case you weren't even married. May be none of them are applicable at this time.

Yes, once she enters the US.

Timeline

I was able to schedule an appointment with the embassy by mailing them. They meticulously studied my documents (marriage records from court, marriage photos; around 200, and old chat logs, honeymoon flight tickets etc). They gave me a visa after a few questions. The whole process was so professional and systematic. I give a thumbs up to the US immigration system. 
 

And this community has been my biggest guide. Without this community I would have had a fairly difficult time. Thanks to all the responders. 


My wife was waiting for me and seeing my wife so happy as I stepped outside JFK on the American side was one of the best moments of my life. 

 

if you were married after your spouse got an E category visa and you need any guidance then please do not hesitate to reach out to me and/or this community.
