the more u wait the longer it is for i-751 to be approved

my suggestion is file i-751 now. it takes forever

 

im really confused, how come ur husband did biometric again for i-485 ? 

didnt it alarm u guys ?

Yeah the 485 and 751 is showing about the same processing time at the moment.

We weren’t notified of us filing the wrong form, they only sent a receipt notice then weeks later, a biometrics appointment notice. We just did as told and attended the appointment and now the case is currently “actively being processed”. The only other biometrics he did was back overseas and I didn’t find it too strange that they want another fingerprint here.

You won't get a refund for filing the wrong form. File the proper form - they may just use the biometrics he did for I-485 for his I-751.

forget about 485 processing time. ur spouse is GC holder. no point of checking GC processing time

USCIS wont refund ur money, the ship has sailed

sorry to break the news to you, but uscis wont use ur i-485 fee to ur i-751 fee because its not their mistake

We already did his biometrics and the case is being processed since May.

My hubbys temp green card expired last November, CR1.

 

What are my remedy options? 

You will not get a refund , but any more delays and you will get a whopping legal fee headache to undo the mistake. 
 

Withdraw the I-485 , write up Request for Late Filed I-751 Cover Letter and reference your mistake..as in YESTERDAY.

Say it later. OP you don;t even have any proof of legal status. No extension letter nothing . Get this filed today for real.
