K-1 as a female in Saudi Arabia

Hello!

first of all, I am sorry if my question is stupid but I have looked around and haven’t found much details. My fiancé is in the US and I plan to get married to him after we apply for a K-1. We have yet to do anything but I have a question!

since you need the women’s guardian to approve of a marriage in Saudi Arabia, does that also apply for applying for a K-1 (in Riyadh)? Would I need a guardian’s approval of the marriage?

Pursuing K1 visa means you agree to getting married in the US, not in Saudi Arabia.  In general, adults applying for a marriage license in the US do not require parents'/guardians' approval.

so,  if you are muslim,  he needs to be muslim also

that's the cultural norm for Islam that muslim woman marries muslim man

That can’t be constitutional.  I’m surprised the courts haven’t over turned this.

Not sure about it. Any marriage in the SA, the embassy may want to see it's done per the country's law/policy for marriage based immigration. For the marriage that will happen in the US, i doubt the embassy will follow the country's policy. Whether SA restricts its citizens from leaving the country to marry someone out of their norm/culture is of course a different story and not in the US embassy's control.

If you are underage for marriage, you may need guardian's approval?

 

In Saudi Arabia, you need to be 18+.

The cultural norms would apply to marriages take take place in the country …US Embassies will accept even same sex marriages in Saudi or any other country where such are banned.

 

So for a K-1 , no marriage contract is involved, therefore nothing out of the ordinary is imposed on the Fiancé.

That is worthy of pointing out. 
OP , are you free to travel in SA now?

Have you traveled internationally without a guardian? 

Are in any danger if your Guardian finds out about your K-1 and intent to marry the American?

In SA, all women will have a male guardian (father, brother, husband, sibling, or even an adult son) whose approval will be required for lots of things they do including marriage and such. OP is talking about approval of such guardianship.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think from a K-1 perspective it would just make it harder to get approved and prove a bona fide relationship especially in muslim countries where it can be harder to get a K1 visa (because the cultural norm is to get married before going to live with someone). 

 

Nothing can legally stop them from granting it because it is the US. But also the embassies are aware about what is culturally appropriate and so I can totally see them being extra suspicious and even asking more questions about it in the interview. In addition, I've see  K1 applicants receive RFEs requesting affidavit of support from family....so it might turn into a situation like that?? So do you need a guardian to apply, probably  not? But may it raise suspicion, possibly so?

I’d love to see an embassy deny a K-1 institution t for the specific reason that the petitioner isn’t a Muslim. Will be a quick case, open and shut case in federal court.

They don’t really kiss and tell now, do they? Besides we can’t even deny “ kissing cousins “, so to speak.
