Hey guys,

 

Obviously we need to file for AOS, but is it really necessary to file I-765? The processing time is currently longer than the one for just the I-485.

 

Seems like a waste of money right? We can work once we have a GreenCard correct?

It's free.   

 

EAD is taking up to 8 months currently.  You will not have a green card before you get the EAD.

When filing I-765 with the I-485, there is no extra fee.

 

I-485 processing times depend on which field office is handling your case.

Current I-765 from the NBC is about 8.5 months for 80% of the cases.

But with California it’s 15.5 months- will that slow down the I-485 processing?

I-485 processing is independent of the I-765 processing.

 

But to answer your original question, is I-765 necessary with the I-485? No, but it is a nice to have in case the I-485 is delayed and there is need to work. And filing I-765 is free when filing concurrently with the I-485.

Personally, given how long basically ANYTHING takes with immi, I'd be filing the I-485, the I-765 and the I-131.  There aren't additional costs when filing concurrently.  Best to cover your behind than not.
