Hello VJ!

Today I renew my Phi passport in Chicago, waiting period is 4-8 weeks or early. Now my question is im confused if my new passport arrive can i change my passport # and my maiden name to married name during gc interview? and if my AP comes first do i have to tell them to change the passport # cos i renew it?

I dont know if you understand what im saying, pls bear with me. Thank you

Now, did you change your name after marriage? If so, did you file AOS with your new last name? If, yes, don't worry. Your AP, EAD and GC will all have the new name

If you are interested in changing your name on the PH PP, you should have figured out how to do it while it's being renewed. Probably your MC + old PP would have got it done.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Hi!

We didn't immediately change my name after marriage, we got married Feb 2022, file my AOS Mar 2022 and today July 25th i renewed my PP to change my last name. I'm wondering what would gonna happen if ever my AP come soon and my PP # is not the same anymore.

I don't know if its possible to email them (USCIS)

I don't understand you. So, we will go step by stsep.

1. Did you pick up husband's last name? Yes or No

2. Does your marriage certificate have a new name? Yes or No

3. Did you file AOS with new name? Yes or No

Your answers for 1 and 2 contradict each other. 2 is only possible if 1 was a Yes.

On 3, If you indeed have a new name, that is, picked up your husband's  last name, then you should have filed your AOS with your new name. There are boxes on AOS that let's you put previous name.

I think we can simplify this with one question.

@BOKURAGAITA , what name did you put in I-485, page 1, part 1? Screenshot below:

If it was your maiden name, and you submitted a copy of your previous passport which was also in your maiden name, then your GC and AP will arrive in your maiden name.

Now, if you don't want this to happen, and instead you want the GC in your married name, you still have a chance. I see from your timeline that you have not yet had the I-485 interview. You have a chance to bring an updated I-485 form and your new passport to your interview, and request that the GC be produced with your married name on it.

I changed my name with the SS immediately after I got married, with my marriage certificate. Therefore, by the time I applied for my gc I already had my married name.

I have heard attorneys suggesting doing it the way I did it, or wait until you naturalize (if you’re planning to), since you’re getting a new passport anyways.
I am not willing to go through the hassle of going to the Argentinian consulate, wasting money on an Argentinian passport (and the trip there!) only to change it a few years after

Thank you very much @Adventine, I don't know exactly if it's possible or too late for me to change in last minute and yes, I don't have my I-1485 interview yet and for sure I will take note and bring an updated I-1485 in the future however if my AP release first? Is there anything I can do to let the USCIS know and change it into my married name? We are expecting to leave the country (my husband and I) for my K2s medical and interview in the Philippines.

If you’re planning on leaving the country, you’re going to use your passport. I wouldn’t change anything now.

@BOKURAGAITA

As mentioned and as I already told you too, your AP, EAD will all come in your maiden name. There's nothing you can do at this point to get them in your married name. You should have filed AOS with married name if you wanted the 2 to reflect such. Now, as @Adventine said, you will have to wait till interview to change things to married name. Then and only then will your GC come in your married name. However, you need to update with IO (you have to tell him/ her as they won't know unless you raise it) and hope the back office that prints GC captures the change before it's printed. If back office fails to capture it, well, you can come back to VJ and we will tell you which route of least resistance to take. I'm not going to write them because that's too much information at this time.

You could have gone @Rocio0010route BUT that ship is now long gone. So, you have to go the @Adventine route.

P.S: If you requested a SS card to be issued, that too will come in your maiden name.

Basically, between now and interview, every document will come in your maiden name. It's only at interview that you can update. Simple.

@BOKURAGAITA I looked at your timeline again and saw there's no info in the I-131 section (for AP / Advanced Parole). Did you send a I-131 form and supporting docs in your AOS packet? If yes, and if you indicated your maiden name there, I'm afraid it's too late. Your AP card will arrive with your maiden name.

However, as mentioned, you have a chance to fix it at the I-485 (AOS) interview. Once you have your GC in your married name, you no longer need the AP.

It isn't wise to book travel back to the Philippines until you have the actual card in your hands and have checked it for any mistakes. Both AP and GC are taking many months to obtain.

Did you file actually AP as asked by @AdventineIf you didn't, you cannot leave the country. I mean, you can leave if you want, but everything will be considered abandoned and you will have to start afresh and go through consulate in Philippines.
