Question about tax transcripts for K1 Visa

Hi everyone, I have a question about tax transcripts for K1 Visa for my girlfriend in Thailand.

I do not have the past three years tax transcripts because I did not make enough money to file, however now I have a full time job that meets the financial needs for K1 Visa.  The K1 was received from USCIS 9 months ago and haven't received NOA2 yet.

My question is if I make enough  money now but cannot provide the last three years tax transcripts because I  don't have any. wilI I end up needing a joint sponsor for the I864 Affidavit of Support form or will I be able to complete this by myself?

Will paystubs and employment verification letter from employer be sufficient or is this not enough.

it is required to have a most reason tex transcript / tax return. Given your timing I suspect that will be your 2022 tax return / transcript.  
 

You don’t have to have tax transcripts / returns for the other 2 tax years. 
 

There is no reason to not file your 2021 tax return and most likely you are costing yourself money.

The deadline for the 2021 tax return was in April though, and 2022's tax return is in January.  I'm sure the case will be moved to the next step before then, so what can I do if there is no tax return available for me to show 2022 until then?

When you don’t owe taxes the deadline to file a tax return is actually three years later. The deadline to file 2021 taxes is April 15, 2025.  
 

Stimulus money. Earned income tax credit: you are leaving money on the table. Go get it while you can.

OK thank you for that.  I will get to file taxes and include them after all.

I didn't know you had three years.

for the K1 it will be I 134 not I 864 (100% not 125% of poverty guidelines for initial K1 interview)

After u marry here in US and Pay the $1225 to AOS for her to stay,  then  u need the I 864 and 125% of poverty guidelines income

 

Read the guides for the process and get familiar with the entire process

Thank you for the information.  I thought I134 was for travel/ and school Visa etc... So is the I864 for the adjustment of status then?

First I134 then I864.  

I have been reading and trying to educate myself on the whole process.

I will read the suggested topics as well.

I-134 is correct. You are thinking of the I-131 which is for Advanced Parole (travel document). You won't have to worry about that until AOS

 

I-134 is similar to the I-864 but it is not legally binding and (generally) they are less strict about income requirements (if you are over 100% of the poverty guidelines you are generally okay with the I-134, but I-864 you MUST show at least 125% income as compared to the poverty guidelines). 

 

Note that that Affidavit of Support for K1 is not needed until the interview stage (you do not send it with the initial petition).

If you need any help or advice, I have done the K1 from Thailand myself back in 2018-2019, and I have helped 3 other people with their K1's from Thailand. You can backfile, or file now for your past few years of taxes and have transcripts in plenty of time for the interview. Have your girlfriend work on the vaccinations you need to get done before she does the medical. Takes about 9 months to get them all done, so start on them now, If you want to PM me I can give you my recommendation for where to get the Vaccines done, and you can get them all completed for around 4000 Baht total, spread out over the course of the series. I also can help you with the police clearance certificate you are going to want to get about 7-8 months into the process. Takes about 5 weeks to get, or I have a connection at the Special police that can do " Express processing" if needed, but better to avoid that when your girlfriend should be able to get it on her own for around 200 Baht. Depends on where she lives in Thailand. IF you need any pointers, message me and I should be able to answer any Thailand specific questions. And when she gets here, you can take a quick trip to Vegas, and I can get you married and certificate in hand in about an hour. Since it looks like your in Phoenix, that is a short flight or drive.
