DQ but NVC left a note about minimum income requirement

 Hello guys. i have had quite a rally with NVC... finished by sending me the mesage that there is and update in my case followed by " the DQ " mail , till now all is ok ; but the attached a note with my case that " this case does not meet the minimum income requirement to sponsor the intending immigrants...a decision will be made by consular officer at time of interview, to avoid delays submit another joint sponsor affidavit I-846A..." ... i guess what created this issue is that my 2020 tax were low...because there was covid ., so what i intend to do is show up at the date of the interview with my most recent bank statement showing that i have more than 125% of poverty guidlines + write an explanation letter to the consular officer to explain that my 2020 tax was weak because of Covid19 shutdown. do you think thats enough?

Current income demonstrates by pay slips are the most important evidence of adequate current income..  bank statements will not show income from a regular job. The letter you received is a standard letter issued for all different triggers. The CO has final say over approval or needing a joint sponsor

Income from Tax returns is irrelevant unless you are self-employed.  You should be prepared to show CURRENT income is above the threshold.  Current annual income is defined by gross income you are capable of generating in the future (based on income you are currently earning).

Most recent pay period gross income multiplied times number of pay periods per 12 months = current annual income.  Regardless, the Consulate Officer is the sole approval authority.  If in doubt, find a well-qualified joint sponsor.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks for reply. Yes i am self employed. So just my recent tax return is enough?

It might help, but you still might want to find a well-qualified joint sponsor just in case.

Your most recent tax return would be 2021.  Is that the one they have? Did you also list and document liquid assets?  

 

The notice you got would be sent even if you had a million bucks in the bank.  If you are confident you qualify based on your 2021 tax return and your savings, simply ignore the message.

The notice you got would be sent even if you had a million bucks in the bank.  If you are confident you qualify based on your 2021 tax return and your savings, simply ignore the message.

 

Thanks for reply. Yes the most recent tax return is 2021.. They dont have it because i filled for nvc before 2021 taxes and i havent listed liquide assets in my affidavit of support. But am positive that my liquide assests are above 125% of poverty guidelines. I will add an explanation letter to justify my 2020 taxes. Fingers crossed. Thanks again

OK, but they won't know about or consider your liquid assets unless you stated and documented them.  If you did, they just have your spouse take updated statements and the 2021 tax return to the interview.  Should upload the 2021 return as well.

Liquid assets must be declared in the I864 if you want to be considered for qualifying using assets ..  and they must be 3x the required annual income level .. or 3x the deficit if income is under the limit.. and they must meet defined criteria as outlined in the instructions for the I 864

So i guess i should filea new i864 with new liquide assets and most recent tax return sign it an give it to my spouse to take with her for interview?

Just fyi in case you didn’t know: There’s a different calculation for using assets to sponsor..for spouse/child beneficiary, total value of assets must equal at least 3x the difference between your household income and poverty guidelines (125%). They provide examples to calculate. Best of luck!

If by file, you mean upload a whole new I-864 and supporting documentation, yes.

"File"??  You "complete" and sign a new I-864, then upload it with all the current applicable supporting documents.  You're already DQ.  They will see the new affidavit and be able to approve the visa. If you don't upload it, they will ask you to and you'll go in another queue before you get an answer on the visa.  Expect at least a month delay.
