Every lawyer I spoke to said they profile based on ancestory/place of birth/religion etc..Goldstein, Hacking,PIC all confirmed this.

 

 

On our tracker,  where is the baby? I don't think there is any baby on that tracker. Even they aren't silly enough to keep a baby in Ds5535 for a year.

If I recall correctly the story about the baby was second hand information. Probably a poster that heard about it anecdotally from an attorney or through their own network. My memory is hazy, but it must've been at least 6 months ago.

 What did you decide to do? Fighting back or waiting it out, since in theory, you should be close.

I decided to fight the motion to dismiss, though I’m pretty confident my number will come up before the process gets that far.

 

I just felt it was prudent to keep the legal door open, especially since the judge in my case is typically pretty friendly to the cause. This is an election year and the border has been in the news for the wrong reasons - theoretically things could get worse and it seemed safer to push on until the request for my passport is in my inbox.

Just submitted my DS-5535 form. Less than half an hour of work for information they mostly had on file. 

 

I heard there is a spreadsheet you guys are keep track of DS-5535 information?  How do I update it with my information.

Smart move. About 1.5 months ahead of you and truly hoping you hear something soon.

 

I think if one hears nothing after 12/13 months , WOM may be the way to go, the only way to potentially avoid an endless hole.

 

Biff Tanen might be coming back, so it would be a good idea to get this sorted before that.

I have a question - maybe there is a better place to ask this?  What if i got the US branch of my company to sponsor me under L1?  Would that help? or would that visa also get denied because of pending DS-5535?

No issue travelling to the US. Been many times and they do not mention anything related to green card or AP.

How many of us have filed their application via attorney? I'd always wonder if have legal representation would prevent DS5535. For those who were represented, what strategies did the lawyers use to expedite the process, if any?

 

Yes, I think DS5535 is random, but I am also convinced that being from the "special" countries listed will increase the chance of you being selected for it. The CO's expression literally changed when he asked my country of origin and my age when I immigrated to Canada (<10yo). I'll be curious to know data on 221g/DS5535 in relation to country of changeability.

My understanding is that each visa application is separate and that being refused under 221g in one shouldn't impact the decision for the other. You can give it a try and see if your employer is willing to fork out the $$ for it. Does your company have a legal entity that can advise on this as well? Worth giving it a try.

Just make sure you have a return date and flight handy when they ask you. A trick - can always purchase ticket same day and many companies (i.e. AC) offer 24h free cancelation. Ultimately, they want to make sure that you wouldn't enter the country and then stay through AOS.
