Sorry to hear about that. Can you tell what is issue with birth certificate translation and what is the requirements for translation?

You should let them know the link doesn’t work. This is a new thing and most people here sent 5535 by email.

Hello everyone, i need help pls, my wife did ab interview back in Feb and they placed her on AP. They requested her passport and some police clearance in March. She was out of the country the whole time. She wasn't able to send her passport. Now that we are back she would like to send her passport and the police clearance they requested but the issue is the medical has expired this month. They didn't requested a new medical exam yet. Should we contact them or she can go to the Dr office and do the medical without their request. Please help us.

I'm trying to figure out what caused us to go into AP. Is it the Military service and answering Yes to "Do you have any specialized skills or training, including firearms, explosives, nuclear, biological, or chemical experience?"

I have a similar timeline. I was interviewed on May 10th and placed into AP then.

I share your pain. My spouse and I are in our late 20s and early 30s, highly educated, pay taxes in the highest bracket in the US, had our work featured on news outlets like CNBC and NYTimes, and still treated like ####### by the US immigration system. Some days we wonder if we are better off just abandoning this whole immigration process and moving to a different country instead.

Sorry for the late reply! But no his status did not change then. Stayed as refused until about a week after they received his passport then it changed to issued.

Hey guys. I just wanted to post our timeline here in case anyone is interested. 
 

* Application to USCIS - April 19 2021

* USCIS approved, case transferred to NVC - April 29 2022

* NVC DQed - Oct 7 2022

* Interview date - Feb 3 2023

* Put in AP same day

* DS 5535 received 3 days later and form sent in Feb 9

* Writ filed May 2 2023

* Last defendant served May 11 - July 10 answer due 

* June 6 request to send passport

- arrived June 12

* Issued - June 21

* Documents received - June 23

 

Couple of notes:

 

Hacking law - who said criteria for filing more focused on date USCIS approved rather than when placed in admin processing. As long as 12 months from USCIS approval they seemed to think it was fine to file a writ. Part of the reason we went with them so we could file sooner.

 

Didn’t realize we couldn’t import our cars because they don’t have a tire pressure monitoring system. Something to look forward to.

 

Husband has received his social but still waiting on green card. Having some issues with drivers license because even though he’s a permanent resident now apparently when the lady looked him up it says his i94 expires in November so she issued his DL with expiry in Nov too. 
 

Other than that I’m glad it’s all over. Such an unfair process for everyone going through this. Good luck to anyone still dealing with AP!! Hope you guys get some good news soon!

My husband had an interview on july 6th and was given the Ds 5535. We filled the form the later day. Since then our last update is changing almost every day and the status is still refused. We are CR1 category. Is that a good thing that these updates are happening almost everyday, just wondering if someone else has experienced this.

Congrats! And thank you for posting your timeline. It will be very helpful for the rest of us behind you. Do you think WoM was what pushed your case forward, or it was already bound to happen regardless? Seems like right around the 96 day mark things started to happen.

More updates is always better than none.

Hi Guy's, Need Advise: I went to interview with my Wife and a toddler for EB Visa. Office told us that he is approving visa and you could get passport in 2 to 3 weeks. However after 3 hours my wife got an email from consulate to fill in 5535 and notified that they can issue visa to your spouse and baby.

 

We Submitted 5535 same day but when I check CEAC status it showed refused both for myself and wife's as well. Don't know if they will issue visa to me and hold for my wife or we all get hold on until Wife 5535 is cleared..?

 

I am really worried as I am working in the US and currently have to take time off due to passport held by consulate. really worried Please suggest if anyone like me gone through this hardship
