Has anyone here had their Canadian crimal record check (valid two years) expire while waiting on the consulate? I'm curious if it's guaranteed that I'll be asked for an updated one. What if I sue, get asked for medical before it expires, but it expires before my visa is issued?

My Medical & Canadian Criminal record check both expired while stuck in AP. I was asked to submit a new Medical and Canadian Criminal record check with my passport and 2 recent passport photos when the consulate was ready to finalize processing.

 

You'll be asked to submit new ones when they are getting close to completing the AP process.

Just wanted to update my husbands status changed to issued today! Says passport should be returned within 10 business days. Hope you get some good news soon! Can’t be much longer!

 

edit to add I’ll update again soon with our whole timeline in case anyone is interested.

Question: can a WOM be filed for not getting an interview call even after being DQ’d for more than year? While Montreal has been prioritizing IR1/CR1 and are processing applications with DQ date as of March 2023, employment based applicants are still as of January 2021 even when these applicants are current as per the visa bulletin. During COVID there was direction to prioritize family reunification however that proclamation was taken back as of Nov 2021. Is there a case here or we just continue to wait?

Quick question, when the embassy does finally request your passport, is there a certain amount of time your passport has to be valid for? For example , would they require your passport to be valid for a minimum of 6 months ?

I’ve seen a few WoM filed attempting to compel interview, but they are usually unsuccessful as consular posts have full discretion to manage their resources as they see fit.

 

You’re better off taking that money you would have spent and moving (as in a genuine relocation) to a different country so that you can interview at the US post in that jurisdiction. Otherwise, not much you can do but wait.

Yes, they usually require at least 6 months validity

Thanks, so if I go ahead and renew my passport right now (while I wait for the DS5535 to be processsed, passport was returned at interview expires in about 6 months as of today ), will that cause any issues when sending in the new passport for visa stamping? Obviously the new passport will have a new # that will not have been mentioned to them before?

I’ve seen similar cases that had no issues.

@justanamericangrl : my status changed to Issued today!! Still waiting on the email but FINALLY!!!

 

1.5 years of administrative process done!!!!! (January 24, 2022 to June 22, 2023). No WOM. Can't wait to see my wife and baby girl!!

I renewed my passport while waiting for the DS5535 to process.  When they requested my passport back I sent both my old passport and the new one with a cover letter explaining that I had renewed my passport and had a new number. It didn't seem to be a problem and they issued the K1 visa in my new passport and returned both passports to me.
