My spouse was detained while crossing the border on 12/24/14. He received a positive credible fear determination from an asylum officer and has been in removal proceedings ever since. He submitted an asylum application and the i797c shows received date was 12/28/15. I am a US Citizen and filed an i130 for him, which was approved in 2017. Our case was referred to NVC and he has an appt for his IR1 visa interview in Honduras in September, so he is awaiting voluntary departure from the IJ. Based on this info, will my husband need an I601/I601A waiver? I appreciate all help/responses!

His lawyer says he does not need it.. I’ve also spoken to another lawyer that says he does not. May I ask why you say he does need it? I keep getting mixed answers and have also spoken to other lawyers before who said he does need it so this is why I’m concerned.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would think it would be safer in most cases to get Petmanent Residency through asylum rather than risking a trip outside the US
