Is this a refusal or denial?

My fiance had his interview today. He received this.  Is this a refusal or a denial? All the officer told him was to contact me to find out what to do.  There are no further instructions listed on this sheet of what to do. I tried contacting the embassy directly and they wouldn't give me any details as to what this was about.

 

I realize that this is in French and had to google translate to understand what it said.

 

it states that he is ineligible to be issued a k1 visa because they feel he is seeking immigration benefits. 

 

the article 212 a listed above that marked box stands for risk of a public charge. I provided an i-134 as well as an i134 for a joint sponsor as we also applied for a k2 visa for his child. The joint sponsor was willing to sponsor both my fiance and his child. We don't know what to do next

That sounds like a denial.....  It will be sent back to USCIS to expire.

He was denied because they did not believe your relationship was genuine. They believe it was entered for the sole purpose of obtaining immigration benefits.

 
which consulate was this?

 

Your next step is either reapply all over again for a K1 (not recommended) or marry and apply for a CR1 (recommended). BUT, before you do any of that, you need to address areas that led the consulate to come to that conclusion. 
 

How much time have you spent in person in total?

One solution is to move to his country and marry to gain quality evidence of time together for a spousal visa.  That is the only sure remedy I know.   IMHO, this is the toughest obstacle to overcome....doubt about the relationship.

US embassy gave him this in  French/  other side probably was written out in English

 

his visa has been denied under "not eligible for a visa at this time"

 

Happens to many of us , including our K1

i returned and married and made several trips to spend quality time with my spouse

 

If u do marry ,  you will have to make a separate petition as the babe would not be included under spouse visa

If you do pursue the CR-1 route, be aware that the bonafides are evaluated even more closely than for a K-1.  My guess is that to overcome the suspicion that he is in it for a green card, you'll need to spend much more time together, commingle your lives some more, and like someone else said:  possibly move to Haiti for awhile.

 

In the time that will take, you can work to improve your financial situation.

This sounds and reads like a denial as they are saying the law does not allow giving a visa for people only seeking immigration benefits through fraudulent relationships
