My I-140 (EB1) has been approved with wife as the derivative. My case has also been marked as documentarily complete by the NVC, and I am waiting for the case to be transferred to the consulate for the appointment. I have a newborn now (who was not a part of i140). Should I approach the NVC or the local Consulate to get the newborn’s details added?

If I approach the NVC,

1) what documents should I send them? 

2) will this then be a new case review and therefore push me to the end of the backlog?

 

If I approach the consulate, what would be the process? And would it be faster vs the NVC?

 

Kindly advise.

Who you contact depends on where your case is. If your case is still with NVC ask them to add a relative (I’m not sure the exact process but I know it’s doable). You’d need to submit a ds260 and documents for the kid. You retain your priority date. If it at the consulate  then you contact the consulate and tell them you need to add a baby to the case. They will instruct you further.
