Now what? Wife passed naturalization but 'decision cant be made'!!

This is so annoying, we go to the N 400 today and my wife passes all test and signs the oath of allegiance. She comes out after about 20 minutes later and asked me to come speak with the officer.

 

The officer says he cant make a decision because our I 751 10 year green card isn't approved (yes its not approved we are still waiting on I 751 10 year green card interview) but because my wife is eligible for citizenship we did N 400 and she took test today and passed everything and was given a piece of paper with the little X mark on it saying the English, civics and history passed.

 

The officer also stated we were the 3rd person today that passed but a decision couldn't be made. He also complained he was only given 20 minutes per interview. 

 

He said we would get something in the mail but didn't say when or if we would be required to submit anything further or come back for an interview.

 

So now what? Do we really need to wait for the I 751 10 year green card interview? Or are they needing something or wanting to look through the I 751 10 year green card documents we sent in last year before decision? 

 

How long is best guess before we hear something?

You need to wait for your wife's I-751 to get adjudicated. 

How long will it take - nobody knows.

 

In my case it took a couple of months but the interview was waived so my N400 status just changed to 'Oath Ceremony Will Be Scheduled'.

I guess I was trying to be funny above, the point is my wife is an American now and speaks English like its the best thing since sliced bread there is no reason for her to wait longer she passed the stupid US exam like I knew she would, they are dragging us through this further and we have to continue to do more I 551 STAMPS in her passport to travel (she had wrong dates on her 2 year green card so we had to surrender it when we filed an I 90 for correction but they didn't do anything with the I 90 or send her 2 year green card back to us once we submitted I 751 10 year Green card application).

 

We (I'm) are very angry about this non sense and incompetence of "a decision cannot be made yet about your application". I mean they should have had out I 751 there and like my immigration friend lawyer said they could have adjudicated on the spot I was there too lets talk!!!!!

 

I'm so P'd off about this, this was end game today....there are no more steps for us, nothing we know of to submit, no more interviews or fees we have to do....we are limbo. I feel for anyone in this position, they should have had everything they need today. 

 

Its like my immigration friend lawyer said, the I 751 is irrelevant, she was eligible to do naturalization and passed regardless of a non approved I 751interview for 10 year green card...next step citizenship and she passed end of story.

 

And also you dont have to have a pre planned combo I 751/N 400 interview, where do some in visajourney members get this from????.....they can adjudicate then and there on the spot a I 751 assuming the citizen spouse is there and I was.

Im really hoping we and anyone of us in the same position don’t have to wait months because our file will sit idle not because they need more from us most likely (it’s all scanned and on a computer with just a key stroke to get) or for us to be questioned again in an interview and believe me I was there and ready if called, so please folks don’t let them fool you……chances are if they ask for anything more it’s to save face and make it seem like it’s you that needs to do something but then again the federal government employees don’t have a problem showing us how little they will do…..files just sitting it’s how government works….we are and any of you  in the same boat probably already done technically speaking. 
 

My immigration friend lawyer knew the guy who gave my wife the exam and said he has had problems with him

before, believe me my friend would know we are in Miami area and he does tens if not hundreds of cases per year and knows the system and immigration officials here.

Did you ask them to adjudicate the  751?

The IO would give quick answers and they all ended with you will get notified, he was pushing us out as fast as he could. He should be fired we felt we were not allowed to ask anything.

The problem was and sorry if I wasn’t clear or didn’t state it, he didn’t want to answer our questions, in fact I was even allowed to sit down in his office just stand outside his doorway…he was rushing us out. Everyone of us deserve a chance to speak about our case….how could you defend that? It’s not my fault immigration is busy or whatever else excuse they give us.

News to me that spouses are allowed to attend an N400 interview.

 

Sounds like the IO was being nice to you by letting you stick around.

The 751 is never irrelevant. Not sure where your immigration lawyer friend got his law degree but the laws are very clear that once someone obtains a conditional GC , conditions must be removed, theres no wiggle room, no bypassing it, no skipping it. The process must be completed no exceptions.

 

Also as you experienced they can't just conduct your 751 interview because you're there and they are there. They need your 751 filing. They need an appropriate amount of time scheduled. 

 

I understand your frustration. The only good news is maybe your 751 will be approved w/o needing an interview. I would suggest reaching out to your congressman for assistance. You can voice your complaints about the process and the failure to have a combo interview as well. 

Thank you but I respectfully disagree, the 751 is just a re hash of the 485 with more pictures and updated month to month personal info.  They can get the file with a key stroke on spot. Trust me they know who is probably legit or not. It has nothing to do with where my friend went to law school…he works many caes every week and SEES some 751s not approved but get approved on spot.

I didn’t go in the interview, I was called in after it was over by him just to tell me we have to wait….We we’re not allowed to ask anything or if they needed anything just “you will get notified “. Now does this sound ok with you that a couple is brushed off rushed out, not allowed to sit down for even a few moments after years of waiting and no next step just when it’s done it’s done email/call or letter?
